Description

1. Subject-matter of the contract: ‘Receipt and management of waste of code 19 12 10 combustible waste (alternative fuel) from Zakład Gospodarki Odpadami Komunalnych Sp. z o.o. w Rzędowie’. 2. The subject-matter of the contract shall include: Collection and management of waste with code 19 12 10, i.e. combustible waste (alternative fuel) from Zakład Gospodarki Odpadami Komunalnych Sp. z o.o. in Rzędów, divided into parts: Part 1: Collection and management of min. 2 000 Mg of waste with code 19 12 10 - estimated amount of waste to be managed: min 2 000 Mg – max 2 500 Mg; Part 2: Collection and management of min. 2 000 Mg of waste with code 19 12 10 - estimated amount of waste to be managed: min 2 000 Mg – max 2 500 Mg; 3. CPV: 90500000-2 waste services 90511000-2 waste disposal services 4. The Ordering Party reserves that certain amounts of waste are indicative amounts and may be subject to change, the Ordering Party guarantees a minimum amount of waste at the level of: 2 000 Mg. for each part of the order. 5. The Contractor shall manage the waste in accordance with the applicable legal provisions. 6. The waste covered by this contract should be transported and then managed in installations that have decisions authorising the treatment of this waste in a manner consistent with applicable law. 7. The waste will be collected by means of transport organised by the contractor and at its expense, including transport and insurance costs for transport and unloading. 8. Once the waste is handed over to the contractor by the contracting authority, all the benefits and burdens associated with them and the risk of their accidental loss or damage are transferred to the contractor. 9. The Contractor is obliged to have a KZR INiG certificate, together with confirmation of the validity of the Contractor's certificate. Having the KZR INIG certificate is tantamount to meeting the requirements for sustainable development, in accordance with the requirements of the RED (Renewable Energy Directive - Renewable Energy Directive - 2009/28/EC). 10. The Ordering Party is obliged to draw up a PoS document (confirming compliance with the KZR) at the request of the Contractor. PoS RDF issued for the invoiced amount of waste transferred in the monthly settlement period. 11. A detailed description of the subject-matter of the contract is described in Annex 8 to the SWZ. 12. The contract in question must be performed in accordance with the applicable regulations and the conditions contained in the RVU. 13. The Ordering Party does not require: - an on-site inspection by the Contractor or - verification by the Contractor of documents necessary for the performance of the contract available on-site at the Contracting Authority. 14. In accordance with Article 95 para. 1 of the Public Procurement Law, the Contracting Authority requires employment by the Contractor, subcontractor or further subcontractor on the basis of an employment relationship, within the meaning of the Labour Code of 26 June 1974 (Journal of Laws 2023, item 1465 as amended) persons performing contract performance activities – in relation to the waste transport service. A detailed description of the employment of persons on the basis of an employment contract is set out in the draft contract, constituting Annex 7 to the SWZ. 15.
