Description

The subject of the contract is the supply of biochemical reagents and reagents for immunochemical determinations together with the lease of an integrated biochemical-immunochemical system. Quantities are set out in Annex 1 to the FTZ – Tender Form The specification form for the minimum parameters required for the equipment is set out in Annex 2 to the FTZ The detailed conditions for the performance of the subject-matter of the contract are set out in the draft contract, which is set out in Annex 3 to the FTZ. Pursuant to Article 441 of the PPL, the contracting authority provides for an option with a maximum value of 40%, i.e. it is allowed to increase up to 40% of deliveries of the subject-matter of the contract in relation to the basic scope, in the event of increased demand, e.g. as a result of an increase in the number of patients, increased frequency of use of the subject-matter of the contract, in the event of delays or prolonged procedures related to the preparation, conduct or completion of a subsequent procurement procedure in the scope of the subject-matter identical to the subject-matter of this procedure or in another case that the contracting authority could not have foreseen. The Ordering Party also reserves that the Contractor is not entitled to any claim against the Ordering Party in the event that the Ordering Party does not exercise the right of option. The Ordering Party also reserves the right not to perform up to 30% of the subject of the contract, in which case the Contractor may demand only the remuneration due for the performance of the relevant part of the contract, without charging any penalties or pursuing claims in this respect. The minimum value of the contract to be performed is 70% in relation to the basic scope of the contract.
