The procurement procedure is conducted in the open tender procedure referred to in Article 132 of the Public Procurement Act (hereinafter referred to as the ‘PPL Act’). 5.1. Name of the task given by the Ordering Party: Bringing students from the area of the Biały Błota Commune to educational institutions. The detailed scope of the subject of the contract is described in the draft contract and Volume III of the SWZ. The Ordering Party provides the Terms and Conditions and all documents constituting its attachments on the website of a dedicated purchasing platform under the link http://platformazakupowa.pl/pn/bialeblota 5.2. CPV (Common Procurement Vocabulary): Main subject: 60172000-4 Rental of buses and coaches with driver 5.3. The tender specifications are hereinafter referred to as ‘SWZ’ or ‘Specifications’. 5.4. Description of the subject of the contract. The subject-matter of the contract is described in detail in Volumes II and III of this FTZ. 5.5. The contracting authority does not allow the submission of partial tenders. The scope and nature of the services under investigation make it necessary to include them in a single contract because of the specific nature of the service. The contracting authority shall require that the organisation of services be carried out within a single company in order to ensure a comprehensive, coordinated organisation of student transport and uniform standards for the provision of services. Lack of division of the contract into lots justified for organisational, logistical and ensuring proper quality and continuity of transport services. 5.6. The contracting authority does not allow variants to be submitted. 5.7. The performance of the contract is subject to Polish law, including in particular the Civil Code Act and the . Public Procurement Law Act. The Contractor will be obliged to perform the services in accordance with Polish law. 5.8. The Contracting Authority does not provide for the possibility of awarding contracts referred to in Art. 1 point 7 of the PPL Act. 5.9. The Contracting Authority shall not require the Contractors to carry out the on-site verification referred to in Article 131 sec. 2 of the PPL Act. 5.10. The requirements for employment by the Contractor or subcontractor on the basis of the employment relationship of persons performing the activities specified by the Ordering Party in the scope of contract performance are set out in the following part of the FTZ. The above requirements shall specify in particular: a) Type of activities related to the performance of the contract, which are related to the requirements of employment on the basis of the employment relationship by the Contractor or Subcontractor of persons performing activities during the performance of the contract, b) Method of verifying the employment of these persons, c) the Employer's powers to control compliance by the Contractor with the requirements related to the employment of these persons and sanctions for non-compliance with these requirements, the Employer requires employment on the basis of an employment contract by the contractor or subcontractor of persons performing all physical work related to the performance of all activities covered by the contract and described in the OPZ, the performance of which consists in performing work in the manner specified in Article 22 § 1 of the Act of 26 June 1974 - Labour Code: drivers authorised to drive buses, buses and/or vehicles. The method of verifying the employment of persons performing work in the manner specified in Article 22 § 1 of the Act of 26 June 1974 - Labour Code and the Employer's powers to control compliance by the Contractor with the requirements related to the employment of these persons and sanctions for non-compliance with these requirements are specified in the draft contract, which is an integral part of the FTZ. 5.11. The contracting authority does not specify the requirements referred to in Art. 2 of the PPL Act. 5.12. The contracting authority does not reserve the possibility of applying for a contract only to the contractors referred to in Article 94 of the Public Procurement Act. 5.13. The contracting authority requires, in accordance with the description of the subject of the contract, that the subject of the contract be carried out taking into account accessibility requirements for disabled persons. 5.14. The Ordering Party does not require the submission of electronic catalogues with the offer. 5.15. The Ordering Party does not provide for settlement in foreign currencies. 5.16. SUBCONTRACTING AND KEY PARTS OF THE CONTRACT: a) The Contracting Authority does not reserve the obligation for the Contractor to personally perform the key parts of the contract. b) The Contractor may subcontract part of the contract. c) The Contracting Authority requests that the Contractor indicate the parts of the contract which it intends to subcontract and that the Contractor provide subcontracting companies, if known, in accordance with point 10.7 IDW. d) Other requirements for subcontracting are set out in Volume II of the FTZ – draft provisions of the contract.
