The purpose of this public contract is to ensure the storage and distribution of medicinal products named Comirnaty manufactured by BioNTech/Pfizer (“Comirnaty vaccines”) containing the SARS-CoV-2 COVID-19 vaccine, which will be procured from state budget funds into the ownership of the Czech Republic on the basis of Commission Decision C(2020) 4192 of 18 June 2020 approving the agreement with the Member States on the acquisition of COVID-19 vaccines on behalf of the Member States and related procedures or otherwise in accordance with the legislation, and which will be delivered by the manufacturer or importer to the Czech Republic in the second half of 2025 and in 2026. At the time the tender procedure is launched, it is not known to the contracting authorities, for objective reasons, in which specific packaging (or combination of packagings) the predominant quantity of Comirnaty vaccine will be delivered to the Czech Republic, stored and distributed by the selected supplier, while Comirnaty vaccine requires, according to the conditions set by the manufacturer, loading and storage in a different temperature (cold) regime, which also involves different material and technical equipment of the supplier. The contracting authorities are only aware that the Comirnaty vaccine intended for vaccination of children under 12 years of age will be supplied in multidose vials (MDVs) that require storage at a temperature regimen of -90 to -600 C, but the quantity of vaccine for children under 12 years of age makes up a completely minor share of the total estimated quantity of vaccine to be distributed and thus does not require specific material and technical equipment of the supplier on a larger scale. For these reasons, in accordance with Section 35 of the PPA, the public contract is divided into lots (Part A and Part B). The tender will result in the conclusion of two Framework Agreements (Framework Agreements for Part A and Framework Agreements for Part B), whereby the distribution of Comirnaty vaccine will always be provided under only one Framework Agreement, depending on the specific predominant type of packaging and the temperature regime in which the vaccines will be delivered to the Czech Republic for the given vaccination season. The Ministry of Health of the Czech Republic (hereinafter referred to as the “Ministry of Health of the Czech Republic”) shall notify contracting entities and selected suppliers within 5 working days of the effective date of each framework agreement (for Part A and Part B) or at least two months before the date of commencement of distribution under the relevant framework agreement of the type of packaging and temperature regime in which the vaccines will be delivered in the predominant quantity in the territory of the Czech Republic, and in connection with whether distribution will take place under the Framework Agreement for Part A or under the Framework Agreement for Part B. In the event of a change in the predominant type of packaging of Comirnaty vaccine to be stored and distributed in the territory of the Czech Republic, during the effective date of the framework agreements, the Ministry of Health of the Czech Republic shall notify contracting entities and selected suppliers of this fact no later than 2 months before the start of distribution of the vaccine in a different type of packaging and at the same time shall notify the end of distribution of the vaccine in the previous type of packaging.
