Description

This consultation concerns: Implementation of the inter-municipal Forestry and Environmental Land Management (AFAFE) in the municipalities of BATTEXEY and HERGUGNEY. Implementation by the Surveyor-Expert of AFAFE’s inter-municipal operation, as provided for in Title II of Book I of the Rural Code, of the municipalities of BATTEXEY and HERGUGNEY. It is stated that: The land development perimeter includes the 2 villages and 2 extensions on the neighbouring municipalities. In accordance with Article L 121-16 of the Rural and Maritime Fisheries Code, in order to be admitted to the competition, any Surveyor-Expert must be entered on the list of surveyors-experts approved by the Ministry of Agriculture for land development operations or authorised to carry out a land development test operation by ministerial decision. In accordance with the judgment of the Council of State of 13 November 1970, the surveyor must not own land within the perimeter of land development because he must meet the guarantees of objectivity because of the nature and importance of his duties. The Surveyor-Expert appointed by the President of the Departmental Council under the conditions laid down in the Public Procurement Code shall elect an address for service at the seat of his office appearing on the table of the Order of Surveyors-Experts.
