The supplier will deliver the products in the requested quantity at the premises of the contracting authority, with the characteristics/specifications contained in the tender submitted and accepted, in compliance with the minimum requirements specified in the tender specifications. Delivery will be carried out by the supplier according to the term assumed in the technical proposal, but no more than the term required in the tender specifications, which runs from the date of signing the subsequent supply contract. Any request for clarifications must be submitted in SEAP (https://e-licitatie.ro/). Pursuant to Article 160 of Law No 98/2016, as amended by Government Emergency Order No 107/2017, economic operators interested in the procedure will request clarifications or additional information in relation to the tender documentation 18 days before the deadline set for the submission of tenders, and pursuant to Article 161 of Law No 98/2016, as amended by Government Emergency Order No 107/2017, the contracting authority’s reply will be sent on the 11th day before the deadline set for the submission of tenders. SUSPENSION CLAUSE - this public procurement procedure is initiated under the following standstill clause: The award of the public procurement contract is subject to the allocation of budget appropriations for the budget year 2025 on the occasion of the approval of the annual budget laws and the rectification laws, required for the procurements provided for in the project, so that the completion of the award procedure by concluding the public procurement contract is subject to the following condition: - the conclusion of the public procurement contract is subject to obtaining the budgetary appropriations from the Ministry of Public Finance through the Romanian Academy for carrying out the Project activities, the signing of the contract being possible only if the budgetary appropriations are secured at a level to cover the expenditure foreseen for the budget year 2025, including the commitments of the Contracting Authority by signing these contracts. - if these budgetary appropriations requested by the Contracting Authority for the purchase of the products subject to the award procedure do not materialise within a maximum of 110 working days from the deadline for submission of tenders, the Contracting Authority will apply the provisions of Article 212(1)(c), second sentence, of Law No 98/2016, making it impossible to conclude the public procurement contract. - Tenderers in this procedure accept the use of the above suspensive condition, assuming full liability for any losses they may suffer in the situation described.
