III.1 Description of the contract III.1.1 Nature of the contract This contract is a supply contract within the meaning of Article 2.20° of the Law of 17 June 2016 on public contracts. III.1.2 Subject of the contract III.1.2.1 Background The CUSL radiotherapy service wishes to replace and improve the restraint systems used in its three treatment rooms (equipped with Varian Edge, Halcyon and Ethos accelerators) and in its simulation room (equipped with a Canon Aquilion Exceed LB simulator). The systems must be identical in all treatment rooms, including simulation, and will be an ā€˜all in one’ solution to cover all treated pathologies such as (non-exhaustive) head and neck, thorax, abdomen, pelvis and limbs (upper and lower) while also allowing complex techniques such as stereotactic treatment and craniospinal irradiation to be carried out. III.1.2.2 Scope The subject of this contract comprises the following elements to be borne by the successful tenderer: 1. If the Simulation TRQ cabinet option is aplicable (dismantling and taking back the Simulation TRQ cabinet without financial compensation); 2. Supply, delivery, commissioning and testing of the new equipment and its possible options; 3. Staff training (use, maintenance, etc.); 4. Guarantee of supplies and services; 5. Delivery of the required documentation. III.1.3 CUSL compatibility For information, the rooms have the following equipment: • Varian Identify cameras in all treatment rooms and Varian Respiratory Gating for Scanners (RGCS) in simulation in the CT of Simulation and Varian Edge; • Varian Visual Coaching Device (VCD) with mounting stand in all rooms; • Vaccum bags Orfit; • Orfit heater at the CT of Simulation for the realization of thermoplastic masks; • Table Qfix Quantum CT (Simulation CT - Canon), Table Edge Perfect PitchTM (Edge - Varian), Table Halcyon 2x (Ethos and Halcyon - Varian). • Storage cabinets in treatment rooms. The proposed solutions must be compatible with the equipment mentioned above. III.1.3.1 Procurement procedure The contract is awarded by open procedure in accordance with the Belgian and European advertising rules pursuant to Articles 35 and 36 of the LOI and Article 11 of the IDA. III.1.4 Lots This framework agreement is divided into four lots: 1. Lot 1: Restraint equipment 2. Lot 2: Supply of (classic) restraining consumables 3. Lot 3: Supply of restraining consumables (double shell mask) III.1.5 Options In accordance with Article 2, 54° of the Law of 17 June 2016 on public procurement, ā€˜option’ means an ancillary element, not strictly necessary for the performance of the contract, which is introduced either at the request of the contracting authority or on the tenderer’s initiative. The contracting authority is under no obligation to exercise the options either at the conclusion of the contract or during its execution. The options will be evaluated against the price criterion as well as the criterion of performance and quality of the equipment. III.1.5.1 Options required Lot 1: Restraint equipment Required option 1: Belly board Required option 2: Repurchase/repurchase of existing equipment. In any event, if the tenderer does not propose a buy-in price and becomes the successful tenderer, it must dismantle and recover at its own expense, free of charge and in accordance with the rules in force, existing equipment within the time limits fixed by mutual agreement between the contracting authority and the successful tenderer.
