Description
I. The subject of the contract is the supply of non-medical and medical equipment and furniture for the Clinic of Neonatology and Intensive Newborn Therapy. The detailed description and the manner in which the contract is to be performed are set out in Annex 2 to the FTZ, in Annex 3 to the FTZ and in Annex 5 to the FTZ, as well as in the model contract. II. The contracting authority does not allow partial tenders to be submitted. The division of the contract into lots is not justified for organisational, technical and functional reasons. The subject-matter of the contract includes the supply of comprehensive equipment intended for one specific organisational unit – the Department of Neonatology and Intensive Care of the Newborn. The scope of the contract includes both medical and non-medical equipment, as well as furniture, which functionally serve to ensure the proper equipment and organization of the Clinic's usable space. These elements remain interlinked in terms of the purpose of the contract, i.e. the preparation of the complete and ready-to-use facilities of the specialist branch. The contracting authority assessed the impact of any division of the contract into lots on the performance of the contract and the achievement of its objective. As a result of the analysis, it was found that the division of the contract into lots could jeopardise the timely performance of the contract and the launch of the activities of the Clinic by increasing the organizational and technical risk, in particular in terms of coordination of supplies, assembly, placement of individual items of equipment, as well as responsibility for the correct performance of the contract in the case of cooperation between different contractors. Furthermore, it should be noted that the subject-matter of the contract has been described in such a way as to ensure that the principles of fair competition and equal treatment of economic operators are respected. The contracting authority did not specify requirements that would unreasonably restrict the circle of potential contractors (the subject of the contract is widely available on the market), and the contract performance model used remains proportionate to its purpose and nature. Taking into account the above circumstances, the Ordering Party considered that the performance of the contract under one procedure and one contract will ensure the most effective, economical and purposeful performance of the contract, reduce the risks associated with the coordination of implementation and will allow obtaining complete equipment of the Neonatology and Intensive Care Clinic in a timely manner and in accordance with the requirements of the Ordering Party. III. In accordance with Art. 1 and lips. 2 and Article 14 para. 1 and 2 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) Ooh, ooh, ooh. Ordering your personal data for the following purposes: 1) conducting a public procurement procedure - pursuant to Art. 1 lit. c GDPR in conjunction with art. 2 lit. g GDPR in connection with the provisions of the Public Procurement Law Act; 2) verification of information on the absence of a criminal record as part of subjective measures of evidence - pursuant to Art. 1 letter c in conjunction with Article 10 of the GDPR in conjunction with the provisions of the Public Procurement Law Act; 3) archiving of personal data – pursuant to Art. 1 lit. c GDPR in conjunction with art. 2 lit. j GDPR in connection with the Act on the National Archival Resources and Archives; 4) establishing, pursuing or defending claims in connection with the conducted activity - pursuant to Art. 1 lit. e GDPR or Art. 2 point f of the GDPR, i.e. processing is necessary for the performance of tasks carried out in the public interest – proper management of the Contracting Authority’s property, i.e. conducting a valid public procurement procedure, guaranteeing the correct spending of public funds. The subject of the contract is carried out as part of a special-purpose grant for co-financing from the state budget of the implementation of the investment program entitled: ‘Establishment of an interdisciplinary centre for the treatment and diagnosis of the Institute of Mother and Child’ - Contract No DOI/FM/SIS/2/106/1155/2023.
