1) The subject of the contract are forest management services as defined in Art. 1 point 1 of the Forests Act of 28 September 1991 (consolidated text: Journal of Laws Journal of Laws 2024, item 530 – ‘Forests Act’) covering nature conservation works to be carried out in the Świętobór Forestry Area in 2025. The contract is implemented on the basis of the Conservation Task Plan for the Natura 2000 site PLH080047 Żurawie Bagno Sławskie – in accordance with the provision ‘Removal of trees and shrubs from the surface of a natural habitat and the habitat of a species along with elevation of the harvested biomass beyond its borders in the period September-December’ and as part of the project ‘Together for nature – protection of species and habitats in areas of natural value’, financed by the European Union from the FEnIKS 2021-2027 programme. 2) The subject of the contract is the removal of natural succession and regrowth on the designated surface of the peat bog - approx. 5.44 ha, according to the attached map – Annex 9 to the FTZ. The performance of the subject of the contract will take place in the Świętobór Forest District, cadastral plot No 307, Jeziorna district, Nowa Sól commune, Nowy Sól district, forest address: 14-09-1-02-122-x-00 and 14-09-1-02-122-i-00 and cadastral plot No 444, Jodłów district, Nowa Sól commune, Nowy Sól district. 3) This task includes the activities referred to in point. 4), which activities should meet the conditions indicated by the Ordering Party indicated in point. 5). 4) Removal of natural succession and regrowth includes: a) manual removal (cutting) of raids and undergrowths of trees and bushes and selected trees growing on the peatland indicated by the Ordering Party, b) removal of tree and bush regrowths that will rebound from the trunks after previously cut raids and undergrowths, c) lifting/exporting the cut biomass from the peatland on their own, d) making photographic documentation from the surface on which protective measures were taken. 5) Works referred to in point. 4) they should meet the following conditions: a) the height of the trunks - bushes and trees should be cut in the same way as the surface of the ground, leaving no protruding carps from which they can reflect the branches, b) when removing successions and regrowths, use: axes, cleavers, hand scythes, hand scythes, chainsaws, (c) technologies ensuring maximum protection of the soil and its cover shall be used during the work, (d) removal of biomass shall be carried out manually, along designated paths, to temporary storage areas and from there exported outside the peatland; in justified cases (only with the consent of the contracting authority) it is permissible to use a light tractor with wide tyres (reduction of pressure on the ground) in order to remove biomass from the place of its harvest (stricte from the peat bog), e) due to difficult access conditions to the peat bog, it is necessary to recognize the terrain and adapt the vehicles to local conditions, f) removal of the cut biomass together with other waste generated during the work is the responsibility of the Contractor. Removal of biomass (and other waste) should be done immediately after felling. The Ordering Party allows the possibility of leaving the cut/extruded organic matter (arrows of trees, shrubs, grass, reeds, etc.) in the form of irregular prisms and piles laid in places designated by the Ordering Party, but not more than 100 m from the boundaries of the surface covered by the treatment. 6) The subject of the contract has not been divided into lots. 7) The Contracting Authority provides for the possibility of awarding contracts referred to in Art. 1(7) of the PHP , within 3 years from the date of the award of the basic contract. The material scope of the services covered by the contracts referred to in the previous sentence shall not exceed 50% of the value of this contract. 8) Communication between the contracting authority and contractors takes place exclusively using electronic means of communication, via the electronic eProcurement platform, available at: https://eZarządenia.gov.pl. 9) Technical and organizational requirements for the use of the eProcurement platform are set out in the Regulations for the use of the eProcurement Platform (https://ezarządenia.gov.pl/pl/regulamin/#regulaminserwisu). 10) By entering the public procurement procedure, i.e. by registering or logging in free of charge (if you have an account on the eProcurement platform), the Contractor accepts the conditions for using the eProcurement platform set out in the Regulations and considers it binding. Using the eProcurement Platform is tantamount to accepting the Regulations. 11) The tender shall be drawn up in Polish, under pain of nullity, in electronic form (i.e. electronic form with a qualified electronic signature) by a person acting on behalf of the contractor. 12) Detailed method of drawing up tenders, declarations referred to in Art. 1 of the Public Procurement Law Act, the subjective means of evidence, the means of evidence in question, and other information, statements or documents provided in this procedure are laid down in the Regulation of the Prime Minister of 30 December 2020 on the method of preparing and transmitting information and technical requirements for electronic documents and means of electronic communication in a public procurement or competition procedure. 13) Offers, statements referred to in Art. 1 of the Public Procurement Act, subjective means of proof, including the statement referred to in Article 117 sec. 4 of the Public Procurement Law Act, and the obligations of entities providing resources referred to in Art. 3 of the Public Procurement Act, the evidence in question and the power of attorney are drawn up in electronic form, in the data formats specified in the provisions issued on the basis of Article 18 of the Act of 17 February 2005 on computerisation of the activities of entities performing public tasks – i.e. the Regulation of the Council of Ministers of 21 May 2024 on the National Interoperability Framework.
