Given the performance objectives of the Client on this operation, the SPEM has opted for the award of a global performance contract in accordance with the provisions of Article L2173-3 of the CCP. The choice of such a mode of devolution leads to the non-allotment of the market and, de facto, to the use of a single market. This global public performance contract includes services provided by: - Design and execution of works, including temporary buildings (schools and catering) if necessary - Operation maintenance of equipment, including those allowing monitoring and compliance with performance. It concerns the primary school Rosière Figone, Located at 79 avenue de la Figone, Marseille 12th arrondissement. The project will consist of 24 classes (9 kindergarten classes and 15 elementary classes). This project is described in the summary note of the program and the "site file" attached to the Consultation Regulation. Total estimated value of the overall public contract: EUR 11 970 000 excluding VAT, excluding the cost of temporary buildings. The work will be carried out on an occupied site. The contracting authority reserves the right to organise, if it considers it necessary, one or more phases of additional dialogue. These phases will be conducted under the conditions to be defined by the contracting authority. The contracting authority reserves the right during the competitive dialogue to optimise, clarify or amend the description of needs. The contract may, as a matter of principle, be concluded with a single contractor or grouped undertakings. If the contract is awarded to a joint group, the representative of the group shall be jointly and severally liable for the performance of the contract on the part of each member of the group for his or her contractual obligations. In accordance with Article R2142-26 of the Public Procurement Code, the composition of the applicant group may not, as a matter of principle, be changed between the closing date for receipt of applications and the date of signature of the contract following the competitive dialogue.
