Description

The purpose of the invitation to tender was to conclude agreements with pharmaceutical undertakings within the meaning of Section 130a(8) of the Social Code (SGB) Fifth Book (V) (hereinafter: Discount agreements or discount agreements) with a term of 24 calendar months on prescription medicines and pharmacy medicines that are not subject to prescription. Pursuant to Section 130a(8) sentence 1 SGB V, the invitation to tender is only addressed to pharmaceutical entrepreneurs or groups of pharmaceutical entrepreneurs within the meaning of Section 4(18) of the German Medicines Act (AMG). It is already clarified that for lots 001 to 050 framework contracts with three tenderers, for lots 051 to 097 framework contracts with two tenderers and for lots 098 to 132 framework contracts with one tenderer can be concluded. In this case, a group of tenderers shall be considered as one tenderer. The minimum bid is 4% on the unit/active substance APU. If there is an offer for a price group that does not meet the aforementioned requirement of a minimum bid and offers a percentage discount of less than 4% on the unit/active ingredient, this price group will be excluded from the offer evaluation. Contractual partners are the pharmaceutical entrepreneurs or employee associations of pharmaceutical companies listed below within the meaning of Section 4(18) of the Medicinal Products Act.
