The object of the public procurement is the conclusion of the contract for the supervision/site supervision of the execution of the C+M works for the project ‘REABILITATION OF THE CORONAMENT OF DEFENCE DIGES AND CREATION OF INFRASTRUCTURE FOR CYCLOTURISTIC TRACES IN THE CRISURI HYDROGRAPHIC BASE’ in accordance with the requirements of the Tender Specifications, in compliance with the legislation in force and the Community regulations. Swimming, Marghita-Border sector Object 3. - Right bank dig Crisul Repede River, Oradea-Border sector Object 4. - Dig left bank River Crișul Repede, Tarian bridge sector - Dig bank right Canal Colector and Dig bank sector right Canal Colector - confluence V. Culiser Object 5. - Dig shore right Canal Collector sector confl. V. Culiser - Dig mal right Crisul Negru River; Dig mal right River Crișul Negru sector confl Canal Colector – Zerind bridge and Dig mal left River Crișul Negru, sector bridge Zerind – Frontier The dams on which the bicycle lanes are intended to be located belong to the public domain of the Romanian State and are managed by the National Administration “Apele Române” through the Crișuri Water Basin Administration. SUSPENSION: The procedure for awarding the public contract is initiated under this standstill clause, in the sense that the conclusion of the public contract for each lot awarded is subject to the allocation of budget appropriations for this purpose, the signing of the contract being made in compliance with the provisions relating to the commitment of expenditure from budgets falling under the legislation on public finances. Having regard to the provisions of Law No 98/2016 on public procurement and Government Decision No 395/2016, as amended, the Contracting Authority states that it will conclude the contract with the successful tenderer only to the extent that the funds necessary for the procurement will be provided by allocating budgetary commitments/credits for that purpose. If, for any reason, the budgetary commitments/credits are not allocated, for a period of 6 (six) months from the date of approval of the report of the procedure and/or from the date of final settlement of any appeals, the award procedure will be automatically cancelled, provided that there is no other source of funding, in accordance with the provisions of Article 212(1)(c), sentence 2 of Law 98/2016, as subsequently amended and supplemented, making it impossible to conclude the public procurement contract. Tenderers in this procedure understand that the Contracting Authority cannot be held liable for any damage in the event of cancellation of the award procedure, regardless of its nature and regardless of whether the Contracting Authority has been notified of the existence of such damage. Tenderers in this procedure accept the use of the above special conditions/standstill clause, assuming full liability for any damage they may suffer in the situation described. Number of days until which clarifications can be requested before the deadline for submission of tenders/applications: 20. The contracting authority will respond clearly and completely to all requests for clarifications/additional information on the 11th day before the deadline for submission of tenders.
