1. The subject of the contract is the supply and installation of a disk array and SAN switches with technical support, warranty and their implementation. 2. The scope of the contract includes: 2.1. supply of the disk array referred to in point IX, Table No. 1 of the OPZ – 1 piece, 2.2. supply of the SAN switches referred to in point IX, Table No. 2 of the OPZ – 2 pieces, 2.3. implementation of the Technical Project referred to in point IX, Table No. 3 of the OPZ, 2.4. implementation of the delivered Devices and Software together with the delivery of the As-built Documentation referred to in point IX, Table No. 4 of the OPZ, 2.5. conduct of the Workshops referred to in point IX, Table No. 5 of the OPZ, 2.6. provision of the Guarantee for Devices for a period of 60 months referred to in point VIII of the OPZ, 2.7. provision of technical support for the Software for a period of 60 months together with the granting of a license for the Software for a period of not less than 60 months referred to in point. VII OPZ. 3. The subject-matter of the contract is described in detail in Chapter II of the FTZ – Description of the subject-matter of the contract. 4. Pursuant to Article 139 of the Public Procurement Act, the contracting authority provides for an inverted order of evaluation of tenders, i.e. it will first examine and evaluate the tenders and then make a qualitative selection of the Contractor whose tender was the highest rated, in terms of the absence of grounds for exclusion and compliance with the conditions for participation in the procedure. 5. The Ordering Party is the administrator of personal data within the meaning of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC hereinafter referred to as "GDPR". 6. The Contractor submits an offer via the eProcurement Platform of the Public Procurement Office - https://ezarządenia.gov.pl/pl/. 7. The Contracting Authority reserves that, in accordance with Article 257 of the Public Procurement Act, it may cancel the procurement procedure if the public funds that the Contracting Authority intended to allocate to finance the contract are not granted to it. 8. The tender shall be submitted, failing which it shall be null and void, in electronic form, in accordance with the requirements strictly laid down in the FTZ. 9. The Ordering Party will not award the contract if the circumstances referred to in Article 5k of Council Regulation (EU) No 833/2014 of 31 July 2014 concerning organisational measures in connection with Russia's actions destabilising the situation in Ukraine (Journal of Laws No. Ooh, ooh, ooh. The Contractor undertakes to perform the subject of the Contract within the following time limits: 10.1. execution and delivery of the Technical Project to the Ordering Party within 14 days from the date of conclusion of the Agreement - culminating in the signing of the partial acceptance protocol (project); 10.2. delivery of the Devices and Software referred to in point IX, Table 1-2 of the OPZ together with the Documentation within 21 days from the date of conclusion of the Agreement, and provision of the Manufacturer's Warranty and Technical Support (resulting from the documents provided), in Working Hours, to the Location - culminating in the signing of the Partial Acceptance Protocol (delivery); 10.3. carry out the Implementation and provide the Ordering Party with as-built Documentation within 7 days from the date of delivery of the Devices confirmed in the Partial Acceptance Protocol (delivery), subject to the need for the Contractor to obtain the acceptance of the Technical Project without reservations by the Ordering Party; 10.4. will conduct the Workshops at the latest by the end date of the Implementation. 10.5. the delivered Devices will be covered by the Warranty Service of the Contractor and the manufacturer for a period of 60 months from the date of receipt indicated in the Final Acceptance Protocol signed by the parties without reservations. 10.6. the delivered Software will be covered by the Technical Support of the Contractor and the manufacturer along with access to the Updates, coming from the official channel of the manufacturer, for a period of 60 months from the date of receipt indicated in the Final Acceptance Protocol signed by the parties without reservations. 11. The contracting authority requests that the tender be accompanied by the means of proof in question to confirm that the supplies offered comply with the requirements set out in Chapter II of the FTZ – Description of the subject-matter of the contract and the criteria for the evaluation of tenders set out in the description of the criteria for the evaluation of tenders in point 19 of Chapter I of the FTZ (in accordance with point 6 of Chapter I of the FTZ - Instructions for Contractors).
