If the origin (brand, trademark, manufacturer, supplier) of materials or standards, approvals, specifications and systems referred to in Art. 5 of the Public Procurement Act, the contracting authority allows the offer of equivalent materials or solutions provided that they guarantee the proper performance of the contract and ensure that technical parameters are not inferior to those assumed in the FTZ. 4.7. The Ordering Party does not reserve the obligation for the Contractor to personally perform the key parts of the contract. 4.8. The Contracting Authority requires that in the event of subcontracting, the Contractor shall indicate in the tender the parts of the contract which it intends to subcontract and (if known to it at this stage) the names (company) of those subcontractors. 4.9. The contracting authority shall allow partial tenders to be submitted. Each Contractor shall have the right to submit a tender for one or more parts of this procedure. 4.10. The contracting authority does not allow the submission of variants within the meaning of Art. 1 of the PPL Act. 4.11. The contracting authority does not provide for the electronic auction referred to in Articles 227 to 238 of the Public Procurement Act. 4.12. The costs of participation in the procedure, and in particular the costs of preparing a tender, shall be borne by the Contractor.
