Description

The specific objectives of the public procurement of the contract are to provide supervision services through site supervisors in order to ensure high quality works (including follow-up services during the failure notification period), to track the correct use of the available funds and to ensure that the Contractor performs the works in accordance with the contractual obligations, in particular as regards the duration, quantity, quality and cost of the works. The Service Provider will have the role and duties of the Supervisor, according to the legislation in the field (Order 1496/2011, Law 10/1995, HGR 1/2018) and these specifications. The provider will take into account the fact that the financing of the execution works is ensured on the basis of a grant granted through the Programme Centre Region (CPR) 2021-2027, Priority 5 ‘Accessible region’, Action 5.1 ‘Investments in the modernisation of road infrastructure of regional importance to ensure connectivity to the TEN-T network’. Consequently, one of the essential objectives of the Service Provider's services will be that through its activity it must ensure the fulfilment of the standards and conditions imposed by the financing contract no. 164/28.11.2024, concluded between the Beneficiary and the Centre Regional Development Agency (RDA) and by the legislation applicable in the field of structural funds. It is also an essential objective of the Provider to prevent and avoid any irregularities in the execution of the works, irregularities that could cause the Beneficiary to lose the funding or its obligation to repay the funding received. The estimated duration of the services provided is given below: -Pre-construction period - 1 month; - The execution period of the works, including the issuance of the reception report at the completion of the works - 32 (30+2) months; - The period of notification of defects minimum 36 months from the reception at the completion of the works - according to the offer of the contractor; - The period of completion of the works, including the issuance of the final reception report and the preparation of the documentation for the completion of the project - 1 month. The estimated value of the supervision services contract (site supervisor), according to the project budget, is RON 1 366 485.88 excluding VAT and does not include the amount of ‘Miscellaneous and unforeseen expenses’ in the amount of RON 136 648.58 excluding VAT, the amount of ‘Expenditure related to the budget margin’ in the amount of RON 204 972.89 excluding VAT and the amount of ‘Expenditure for establishing the implementation reserve for price adjustment’ in the amount of RON 136 648.58 excluding VAT, established in accordance with Government Decision No 907/2016, which are not to be offered and can be accessed, as necessary, during the implementation of the contract by amending it under the conditions laid down in Article 221 of Law No 98/2016, as amended.
