Description

1. The subject of the contract is the purchase of 7-passenger vans with increased parameters in an unmarked version and 8-passenger vans in an unmarked version for the Police Training Center in Legionowo. 2. The term "vehicle" shall be understood as defined in the Road Traffic Act of 20 June 1997 (Dz. Journal of Laws 2023, item 1047 as amended. A detailed description of the subject-matter of the contract is set out in the ‘Description of the subject-matter of the contract’ section of the SWZ, which constitutes Annexes 8 and 8a to the SWZ. 3. The contracting authority provides for the possibility of exercising the option referred to in Article 441 of the Act. The right of option may be exercised only after the completion of 100% of the value of the basic contract, in the case of having funds and the need to order more vehicles than provided for in the basic scope. The value of the contract awarded under the option right depends on the available financial means. 4. The Contracting Authority provides for the possibility of exercising the right of option to the extent indicated in the procurement documents, at the prices specified in the tender, subject to the provisions of the draft contract, constituting Annex 9 to the SWZ. 5. The Ordering Party reserves that the part of the order defined as the right of option is a right and not an obligation of the Ordering Party. Execution of the option may or may not take place, depending on the financial capabilities of the Ordering Party. Failure to perform the order in this respect will not cause any claims on the part of the Contractor. 6. In the case of exercising the option right, settlement will take place on the terms included in the concluded contract. 7. Under the contract in question, the contracting authority envisages purchasing: Basic contract: - 3 vehicles of the 7-passenger van type with increased parameters in an unmarked version; - 1 vehicle of the 8-passenger van type in an unmarked version. Orders under the option: - 2 vehicles of the 7-passenger van type with increased parameters in an unmarked version; - 4 vehicles of the 8-passenger van type in an unmarked version. 8. The Contractor is obliged to perform the contract on the terms and conditions described in the draft contract constituting Annex 9 to the SWZ. 9. The subject of the contract under the basic contract (4 vehicles) will be delivered to the Employer's headquarters at the Contractor's expense by 16 December 2024. If the Employer exercises the option right, the delivery of 6 vehicles under the option right will be carried out by 30 December 2024 at the latest.
