SUSPENSIONAL CLAUSE: The completion of the award procedure by concluding the public procurement contract is subject to the following condition:- the conclusion of the public procurement contract is subject to obtaining / approving the financing of the project submitted under the National Programme for Investment in Hospital Infrastructure - PNIIUS, the signing of the contract being possible only if the provisions relating to the commitment of expenditure from budgets falling under the legislation on public finances are complied with; - if, for whatever reasons, the project funding under PNIIUS is not obtained/approved within 90 working days of the deadline for submission of tenders, the Contracting Authority will apply the provisions of Article 212(1)(c) sentence of Ila of Law No 98/2016, making it impossible to conclude the public procurement contract; - Tenderers in this procedure accept the use of the above suspensive condition, assuming full liability for any losses they may suffer in the situation described.
