The Contractor must perform all activities to ensure the construction of the site, in accordance with the Terms of Reference for the elaboration of a technical design and a draft DDP, the Contracting Authority's requirements for the implementation of the specific site (Annex № 1 to the documentation) and the Contract for the execution of the public procurement. The tender documentation is accompanied by the conceptual solution, which is for the information of the participants in the procedure only. Errors and incompleteness in the conceptual design provided by the Assignor do not constitute its risk and cannot be grounds for claiming any additional costs on the part of the Contractor. Within the framework of the technical project, the Contractor shall examine the existing networks and facilities of the technical infrastructure falling within the scope of the development, as well as the future investment intentions for the construction of such, and shall develop projects for their protection and/or reconstruction, agreed with the respective operating company or department. On the basis of Article 137(1)(1)(a) of the Spatial Development Act, the construction is a first category. Pursuant to Article 5(1)(2) of the Rules on the procedure for entering and keeping the Central Professional Register of Builders, issued by the Bulgarian Construction Chamber, the construction is a second group: construction of transport infrastructure.
