On the basis of the ‘Procedures for the conclusion of the articles of association PCC INTERMODAL S.A.’ of 28.2.2013, available on the Company’s website www.pccintermodal.pl/przetargi, launches a call for tenders: for the supply of a container handling vehicle (reachstacker) to the container terminal PCC Intermodal S.A.w Kutnie, together with the provision of a service.
The Civil Code Act pursuant to Articles 701-705 applies to the award of the contract in question.
The subject of the invitation to tender is the supply of one new reachstacker device for handling empty containers, with a capacity of 10 tonnes in the first place.
The estimated date of delivery of the complete exco terminal in Kutna – within four months of the date of signature of the contract.
Expected date of award – November 2014.
The tender will consist of two phases. The first pre-selection of applications will be carried out.
Interested parties must submit their applications signed by the persons authorised to represent them, together with the documents required at the first stage of the invitation to tender, no later than 12:00 no later than 16 October 2014. Documents must be provided to:

Applications for participation in the invitation to tender must be fixed and sent in a sealed envelope indicating:
Application for tender for the supply of a container handling vehicle (reachstacker) for the container terminal PCC Intermodal S.A. in Kutna, together with the provision of a service.
The applicant’s admission to the first stage of the procedure is subject to the production of up-to-date formal documents:
— Cover letter setting out the scope of the tenderer’s activities. The contact person(s) (name, surname, telephone number, e-mail address) should also be provided.
— Declaration that it is possible to deliver the equipment within the time limit laid down in the model notice – Annex 1 to the application.
— A registration document or other document competent to the applicant for a judicial or administrative record certified by the persons authorised to do so. It is permissible to submit a printout from the service: https://ems.ms.gov.pl/.
— The original of the power of representation in the present proceedings, if the applicant is represented by an agent.
— A certificate from the competent Head of the Tax Office and the competent branch of the Social Insurance Institution confirming, respectively, that the applicant is not in arrears with the payment of taxes, fees and health or social security contributions, or certificates that he has obtained a legal waiver, deferral or payment of arrears in instalments or suspension in full of the implementation of the decision of the competent authority.
— Declaration by the person authorised to represent the applicant that no winding-up or insolvency proceedings have been opened against the applicant, nor has the applicant been declared bankrupt or wound up.
— The obligation to keep confidential information confidential, in accordance with the model in Annex 2 to the notification given on the website www.pccintermodal.pl, under the heading ‘On the firm/Tendering’, signed by the persons authorised to represent them.
— Presentation of the characteristic curve of the dependency of the machinery’s working load on the spreader range, together with an indication of the type and model of the device.
All copies of documents must be certified as true copies by the person(s) empowered to do so. The documents referred to above will be binding only if they were issued no later than three months before the deadline for submitting applications for this procedure, i.e. from 16.7.2014 to 16.10.2014.
If the documents referred to above are not issued in the country in which the applicant is established, they shall be replaced, as appropriate, by documents containing a declaration made before a notary, a competent judicial, administrative or self-regulatory body for the country in which the Contracting Authority is established.
In the first stage, the applicants will be pre-selected. Applications from entities which do not submit a set of up-to-date formal documents meeting the criteria set out above will be rejected.
Entities that have submitted a set of up-to-date formal documents meeting the criteria set out by the Contracting Authority will then be assessed in the light of the following substantive criteria:
— Necessary knowledge and experience in carrying out tasks of a similar nature, scope and technical complexity – weighting up to 50 %,
— Service capacity to perform the contract – weighting up to 30 %. Service capacity, understood as having qualified maintenance personnel – a minimum of five service providers;
— Economic and financial standing to perform the contract – weighting up to 20 %.
In order to verify and assess the substantive criteria, the applicant will submit the following documents together with the formal documents:
Ad1. References to the proper execution of the works:
A minimum of 3, but no more than 5 references awarded to the tenderer by the users of the equipment in the last 5 years from the date of publication of this invitation to tender. The references must relate to the supply of at least three reachstacker devices, in particular a minimum of one of the references should also cover warranty and post-guarantee services with similar or similar technical characteristics to those of the equipment to which the invitation to tender relates. The contracting authority authorises references certifying the delivery and servicing of reachstacker equipment with parameters higher than expected for the equipment covered by this invitation to tender.
For the 3 references meeting the above mentioned criteria, the note is 50 points, whereas the 3 references meeting the above mentioned criteria are not provided with 0 points. No additional points will be awarded by the Contracting Authority for more than three references. References will be assessed against the above criteria in order of order of their inclusion in the notification. References with order number 5 or more will not be taken into account.
The contracting authority will not award sub-points.
Ad2. List of service units and declaration of maintenance personnel:
The applicant is required to provide a list of service providers (in the form of Annex 3 to the application, in accordance with the model given on the website www.pccintermodal.pl under the heading ‘On the firm/Tendering’), which shows that, for the period of implementation of the provisions of the maintenance contract, it will have at its disposal qualified maintenance personnel of not less than five persons, through which it will provide warranty and post-guarantee services for the equipment supplied. Alternatively, the Tenderer may provide a declaration of availability of at least five qualified service providers who, on behalf of the Tenderer, will provide service services during the term of the contract.
The tenderer must document the qualifications of its service providers.
The tenderer must also provide a list of its own service units, i.e.: workshops/establishments indicating the location and address and a list of mobile service units in Poland, together with their working hours authorised to service the reachstackers that are the subject of the tender.
During the term of the service contract, the Tenderer will be obliged to maintain the service capacity offered.
In the Tender Specifications, the Contracting Authority will also specify the service response times required to ensure the desired efficiency of the equipment. The response time of the service will also be specified in the contract, failing which penalties will be charged.
30 points will be awarded for documented proof of the required and qualified staff, i.e. the submission of a list of service units and completed and signed by the persons authorised to represent the list of servicers in accordance with the model of Annex No 3 or the submission of a declaration to that effect. The absence of a list of service units or a list of service providers (or no declaration of availability of maintenance personnel) or the provision of fewer staff than required by the Contracting Authority for the duration of the contract means 0 points.
The contracting authority will not award sub-points.
Ad3. Documents setting out the economic and financial situation:
The financial statements and, in the case of entities not required to prepare financial statements, other documents equivalent to the turnover, liabilities, receivables and profit or loss of the entity, understood as net profit or loss. The above documents should be submitted for 2012 and 2013 or for periods similar to those mentioned above for undertakings with a financial year not overlapping with a calendar year.
Marking: financial statement or equivalent document for 2012, or a period similar to net profit – 10 points. If there is a net loss or no report attached, 0 points.

The financial result presented in the documents, understood as a net profit (loss) equal to ‘0’, will be considered positive by the Contracting Authority.
The contracting authority will not award sub-points.
The contracting authority attaches Annexes 1-3 to the content of the notice, which are in force in the content indicated by the Contracting Authority. The applicant will complete and sign the attachments in the spaces designated for this purpose. Any deletion or additions intended to modify their content shall be inadmissible and shall be treated as failure to lodge a specific document.
The Procurer will qualify the Applicants for the next stage, who will score more than 80 points.
The criterion for selecting the Contractor as a result of the second stage of the tendering procedure will be the amount of the net remuneration, and the Tenderer must indicate which part of the remuneration relates to the servicing services.
In case of lack of or ambiguity in the notification documents, the contracting authority will ask each of the Notifiers in whose documents the absence(s) or ambiguities are found to provide explanations or to remedy the deficiency(s) within 3 working days.
Information relating to the second stage, i.e. the conditions for participation in the procedure, a detailed description of the subject-matter of the contract, including, inter alia, detailed technical requirements for the equipment to be tendered (e.g. expected reachstacker loads in individual rows or distance reachstackeran load), as well as information on the date and place of submission of tenders will be specified in the Tender Specifications. These specifications will only be made available to entities admitted to the second stage of the tender.
The contracting authority informs that the second stage of the procedure will be conducted in the form of an electronic auction using the PCC Group’s purchasing platform.
Together with the Specifications of the Tendering Entity, the Contracting Authority will also submit to the Tenderers the current contract for the sale of the equipment and the contract for servicing it.
The contracting authority informs that, in the second stage of the procedure, qualified entities will be required to lodge a security of 10 thousand. PLN.
Initial technical characteristics of the device (reachstacker):
— a minimum load of 10 tonnes in the first row of containers and a minimum of 5 tonnes at 6 500 mm distance (centre of loading from the front wheels of the device),
— the possibility of excursions to the height of storage of containers in 6 layers, for the height of the 8‘6 container’,
— automatic spreader spacing 20', 30' and 40',
The selection criterion in the second stage will be the price, according to the details set out in the Specifications.
In the sales contract annexed to the Specifications, the Tenderer will be obliged to agree to the possible financing by PCC Intermodal S.A. of the purchase in the form of external financing with the participation of an entity selected by the Contracting Authority.
The contract will be concluded by accepting the tender by the Contracting Authority once one copy of the contracts signed secondaryly by the Contracting Authority for the supply and servicing of the equipment has been handed over to the successful tenderer.
The security shall be returned to the successful tenderer within 14 days of that date. The security shall be released to the other tenderers without delay and at the latest within 14 days of the date of award or cancellation of the tender.
The specifications of the subject-matter of the tender (together with the contract for the sale of the equipment and the contract for servicing it) will be sent to the persons designated by the Tenderers as contact persons.
This invitation to tender will be carried out in accordance with the ‘Procedure for the conclusion of contracts (for projects co-financed with EU funds under the Operational Programme Infrastructure and Environment)’, which is available on the Company’s website at:

The tender will be conducted on the basis of Polish law and any disputes will be settled by the competent Polish courts.
The provisions of the Public Procurement Act of 29.1.2004 do not apply to this call for tenders.
The Contracting Party reserves the right to amend the notice or the terms of the tender at any stage. The Contracting Authority reserves the right to cancel the tender at any stage of the procedure or to leave the tender open.
All correspondence with tenderers will be in Polish. Documents drawn up in a foreign language should be correctly translated by the Tenderer into Polish.
PCC Intermodal S.A. signed an agreement to co-finance the project from the European Cohesion Fund under the Operational Programme Infrastructure and Environment Action 7.4.
