Description

Common Procurement Vocabulary (CPV): 09.30.00.00-2 electricity, heat, solar and nuclear.
1. The subject of the contract is the purchase of electricity for teaching facilities, Student houses and other facilities of the University of Gdańsk located within the administrative boundaries of the Pomorskie Province.
2. The sale of electricity will take place under the conditions laid down in the following provisions:
1) the Energy Law Act of 10.4.1997 (Journal of Laws 2012, item 1059 and 2013, item 984) together with the implementing acts that apply to this Agreement, hereinafter referred to as “Energy Law”;
(2) the Regulation of the Minister for Economic Affairs of 4.5.2007 on the detailed conditions for the operation of the electricity system (Journal of Laws No 93, item 623, as amended), in particular customer service standards;
(3) of the Civil Code of 23.4.1964 (Journal of Laws No 16, item 93, as amended), hereinafter referred to as the “Civil Code”;
(4) the Public Procurement Act of 29.1.2004 (Journal of Laws 2013, item 907, as amended), hereinafter referred to as ‘Public Procurement Law’;
(5) in accordance with the rules laid down in the Contractor’s concession.
3. A detailed description of the subject-matter of the contract, estimated consumption and addresses of the premises is set out in Annex 1 (to the contract).
4. The contracting authority does not guarantee the purchase of the planned amount of electricity specified in the estimated 24 months’ energy consumption (32 862.7 MWh) – this is the amount envisaged not binding on the Contracting Authority, the actual amount of electricity supplied will result from current metering and billing systems, each consumption point.
5. The number of electricity consumption points may be reduced as a result of the disposal by the Contracting Authority of certain facilities listed in Annex 1 (to the contract).
6. The number of electricity consumption points may also be increased as a result of the extension of the Contracting Authority’s facilities not listed in Annex 1 (to the contract).
7. Billing for the performance of the subject-matter of the contract will be made at prices based on a flexible electricity purchase model for each consumption point, based on actual energy consumption.
8. The submission of a power purchase order shall take place in accordance with the following rules:
(8.1) The contracting authority submits the order on ‘x’ by 10.00 a.m. for quotations from the Energy Exchange S.A. (TGE) held on ‘x-1’ days. The order is sent to the following email address: The contractor. The order shall indicate the percentage of the tranche and the type of product.
Confirmation of execution of the order shall be sent to the Contracting Authority on the same day by 15:00 to the Contracting Authority’s email address.
8.2) The contract will be executed on the basis of the settlement price for the product BASE_Y-16 and BASE_Y-17 or BASE_Q-n-16 I BASE_Qn-17 (n – refers to the quarter number) specified for these products on the website (TGE) on ‘x-1’.
Until 30 December 2015 for 2016 and until 24 December 2016 for 2017, the Contracting Authority has the option of contracting up to 100 % of the declared volume of conventional electricity consumption for a given year. “black” based on listed stock exchange futures indices BASE_Y-16 and BASE_Y-17 published on the TGE website. The remaining part of the declared energy for 2016 and 2017 resulting from the difference between the declared volume and the volume contracted based on the BASE_Y-16 and BASE_Y-17 term indices may contract in the BASE_Q-n-16 and BASE_Qn-17 term indices, but by hedging the planned volume for each quarter until the 25th day of the month preceding the beginning of the quarter in question.
8.3) If 100 % of the volume is not contracted for a given quarter, the Seller is entitled to apply any price for the following days after the 25th day of the month preceding the beginning of the relevant sales quarter, for BASE_Q-n-16 and BASE_Qn-17.
8.4) The contracting authority is entitled to a maximum of four tranches per year.
9. The Contractor’s remuneration may be modified only in the cases referred to in Section 12. Point 6 of the Agreement.
10. The prices referred to in Paragraph 4(a) 1 contracts are also valid for newly connected plants to the DSO’s electricity grid, with the proviso that the Contracting Authority is entitled to increase the number of energy consumption points in accordance with the provisions of point 6.
11. The contracting authority informs the Contractors that the provision of distribution services – the Distribution System Operator (OSD) is ENERGA Operator S.A. with its registered office in Gdańsk.
12. The contractor must have a General Distribution Agreement with the Operator of the Distribution System Energa Operator S.A. with its registered office in Gdańsk.
13. All the Contracting Authority’s collection points have metering and settlement systems adapted to the change of seller.
