The subject of the contract is the supply of single-use medical devices for the needs of Copernicus Leczniczy Sp. z o.o. in Gdańsk, the detailed description, assortment and estimated quantities of which are contained in the Assortment and Price Form - Annex No. 1 to the SWZ (parts 1-70). The Contractor, by completing the entries in the column ‘Indicate yes/no’ ‘Describe’ or ‘Describe yes/no’ and/or ‘Indicate parameters’, confirms that he meets the requirements specified by the Contracting Authority, if applicable. The offered items of the order must be complete, of a high standard both in terms of quality and functionality, as well as free from defects in materials, construction and legal. The offered subject of the contract must be allowed to be marketed and used in accordance with applicable law. The subject of the contract must comply with the Act of 7 April 2022 on medical devices (Dz. Journal of Laws 2022, item 974 of 2022.05.09) - if applicable. In all the provisions of the SWZ and its annexes, in which the Contracting Authority refers to standards, approvals, technical specifications or reference systems or indicates trademarks, parameters or sources of origin (names of manufacturers or devices), in accordance with Art. 5 and Article 101 para. 4 of the Public Procurement Act, the Contracting Authority allows equivalent solutions. The method of performance of the subject-matter of the contract is specified in the draft contracts contained in Annex 5 to the SWZ. The Contracting Authority does not reserve the possibility of applying for a contract only by the Contractors referred to in Article 94 of the Public Procurement Act. The contracting authority does not impose the requirements referred to in Article 96 of the Public Procurement Act. In order to submit an offer, the Contracting Authority does not provide for the Contractor to carry out an on-site inspection or check the documents necessary to perform the order available on-site at the Contracting Authority. The contracting authority does not request that the means of proof in question be submitted with the tender (Article 107 of the Public Procurement Act). Contractors who are not subject to exclusion from the procedure due to one of the circumstances indicated may apply for the award of a contract: a) in Article 108 para. 1 of the Public Procurement Act, which occurred within the relevant period specified in Article 111 of the Public Procurement Act, b) in Article 7 sec. 1 of the Act of 13 April 2022 on special arrangements for counteracting the support for aggression against Ukraine and for safeguarding national security, c) Article 5k para. 1 Council Regulation (EU) 2022/576 of 8 April 2022 amending Regulation (EU) No 833/2014 concerning restrictive measures in view of Russia’s actions destabilising the situation in Ukraine (hereinafter: Regulation of the Council of the EU). The Contracting Authority does not provide for exclusion of the Contractor on the basis of Art. 1 of the Public Procurement Act (optional grounds for exclusion). The Contracting Authority may exclude the Contractor at any stage of the procurement procedure (Art. 1 of the Public Procurement Act). In particular, in order to implement the prohibition referred to in Art. 1 Regulation of the Council of the EU, prior to the conclusion of a public procurement contract, the Contracting Authority may require the Contractor to confirm the validity of the declaration made in this respect. Before selecting the most advantageous tender, the Contracting Authority shall call on the Contractor whose tender has been the highest scored to submit within a specified time limit, which shall not be shorter than 10 days, valid on the date of submission of the subjective evidence described in § X para. 1 SWZ. The Contracting Authority informs that it may first examine and evaluate the tenders, and then make a qualitative selection of the Contractor whose tender has been awarded the highest score, as regards the lack of grounds for exclusion and fulfilment of the conditions for participation in the procedure. Participation in the procurement procedure shall be subject to the lodging of a tendering security of the correct amount for the lot for which the Contractor submits a tender. The amount of the security for total bids is PLN 58,000.00, for partial bids, in accordance with § XV SWZ. The tendering security must be lodged before the closing date for the submission of tenders and maintained without interruption until the closing date for the submission of tenders. The contracting authority does not require a performance bond. The draft contract is attached as Annex 5 to the SWZ. Detailed information is provided in Annex 5.
