Description

Midttrafik wishes to change sub-index for the terms governing sub-index for wages in the cost index under which the operator payment is regulated in the contracts concluded after the 65th tender for urban and local bus services in the Municipality of Viborg, Contract Notice No 2022/S 213-612663. Sub-indices for wages from ILON12, total TOT occupations, seasonally adjusted, are changed to SBLON1, total TOT occupations, enterprises and organisations, as due to the technical handling of the high inflation in Statistics Denmark's calculation of ILON12, total TOT occupations, seasonally adjusted, there has been shown to be a significant difference between the development in ILON12, total TOT occupations, seasonally adjusted, and the development in the actual labour costs of the operators. The purpose of the amendment is to bring the indexation into line with the parties’ common understanding and assumptions as they were at the time of the invitation to tender and the submission of tenders. On that basis, Midttrafik takes the view that the replacement of sub-indices does not constitute a modification of the contracts.Even if the opposite were the case, the amendment, which does not alter the overall characteristics of the contracts, would be based on circumstances arising from unforeseeable circumstances, cf. Article 89(1)(c) of the Utilities Directive (2014/25/EU). Text automatically translated in your browsing language Automatically translated
