Any interested economic operator has the right to request clarifications / additional information in relation to the tender documentation 22 days before the deadline set for the submission of tenders. The contracting entity will respond clearly and completely to all requests for clarifications/additional information in relation to the tender documentation on the 12th day before the deadline for submission of tenders. The contracting entity will not respond to requests for clarifications submitted after the deadline set. The activity of the Contractor/Supervisor is to supervise, as ‘Supervisor’, the design and execution of works, as well as during the guarantee period of the works, in order to monitor the correct use of the available funds and to ensure that the Contractor designs and executes the works in accordance with the contractual obligations, in particular as regards the duration, quantity, quality and cost of the design and works in accordance with the provisions of Government Decision No 1/ 2018 approving the general and specific conditions for certain categories of procurement contracts related to the investment objectives financed from public funds. Within the consultancy services and the supervision of the design and execution of the works related to the investment objective ‘Implementation of the measures necessary for the operation of the ERTMS system on the Predeal – Bucharest – Constanța railway section and extension of the GSM-R system on the primary rail transport network – LOT 1 – Civil works for the Operational Control Centre – CNMT Bucharest’, the Contractor will carry out coordination, consultancy and supervision activities. SUSPENSION CLAUSE: The award procedure shall be carried out under this standstill clause. The conclusion of the sectoral procurement contract is conditional on obtaining / approving the financing of the works from state budget funds and / or non-reimbursable European funds, the signing of the contract being possible only if the provisions regarding the commitment of the expenditures from the budgets falling under the legislation on public finances are complied with. If, for any reason, the procurement/approval of works from state budget funds and/or non-reimbursable European funds is not carried out, the Contracting Entity shall apply the second sentence of Article 225(1)(c) of Law No 99/2016, as subsequently amended and supplemented, making it impossible to conclude the sectoral procurement contract.
