ATiK services for ORACLE products and PASS & Iaas Universal Credit
1. The subject of the contract is: 1) provision by the Contractor to the Contracting Authority of Technical Assistance and Maintenance (ATiK) services in relation to Oracle software and server infrastructure, for which licences have previously been granted to the Contracting Authority under separate agreements; 2) purchase of rights to use the Oracle Paas & IaaS Universal Credit Service on Oracle Cloud Infrastructure or equivalent services; 3) the right of option, the scope and conditions of which are set out in § 3 of the Draft provisions of the contract, constituting Annex No. 2 to the Specifications of the Contract Terms and Conditions regarding this procedure (hereinafter referred to as "SWZ"), published on the Purchaser's purchasing platform https://pkpintercity.eb2b.com.pl). 3. A detailed description of the subject of the contract is contained in Annex 1 and 2 to the FTZ. 4. If a solution equivalent to the one referred to in para. 1 point 2, the tender should be accompanied by documentation of this solution confirming compliance with the requirements described in paragraph. 5 below, the full terms of the license and a list of the full functionality of the equivalent solution. 5. As an equivalent service, the Employer will consider one that meets the following conditions: 1) allows access to cloud services such as Platform as a Services (PaaS) and Infrastructure as a Service (IaaS) without specifying what these services are to be and without the need to purchase a separate license (licences necessary to run and operate the service will be available in the "License Included" model); 2) The Ordering Party will be able to freely change the services it will use during the contract performance period; 3) the scope of application of the technology will provide the Ordering Party with the possibility of implementing the functionalities that the Ordering Party implements based on Oracle technology, in particular it will enable the Ordering Party to maintain and develop systems based on the Oracle Autonomous, Oracle Golden Gate and Oracle Analytics Cloud database, without the need to purchase additional licenses, perform additional adaptation works or migration; 4) will cooperate with the other systems of the Ordering Party built on the basis of Oracle technology, implemented at the Ordering Party, to which the Ordering Party has license rights, and will ensure the operation of these systems as implemented by Oracle technology, without the need to purchase additional licenses, perform additional adaptation works or migration; 5) will not cause disruption to the work of the software in the field of Oracle technology with which it will interact; 6) provide full, parallel real-time operation and full functional interchangeability of technology equivalent to Oracle technology; 7) ensure data sovereignty and make it possible to determine the place of data processing in the European Economic Area (EEA).
