The subject of the contract covers the successive supply of liquid fuel - ON diesel in the amount of approx. 240 000 litres including deliveries to the places of the Ordering Party as below: a) Zakład Unieszkodliwiania Odpadów Komunalne RUDNO Sp. z o.o. Rudno 17, gmina Ostróda (fuel tank with a capacity of 5m3 and a fuel tank with a capacity of 2.5m3 - the minimum amount of one-time delivery of about 2m3), b)Communal Waste Transshipment Station in Lipowiec, gmina Kurzętnik 53D, (fuel container with a capacity of 2.5m3 - the minimum amount of one-time delivery of about 0.5 m3) c) Communal Waste Transshipment Station in Półwieś 26A, gmina Zalewo, (fuel container with a capacity of 2.5m3 - the minimum amount of one-time delivery of about 0.5 m3) d) Communal Waste Transshipment Station in Iława ul. Municipal 1, Iława Municipality (fuel container with a capacity of 2.5m3-minimum amount of one-time delivery about 0.5 m3) 2. As part of the successive delivery of diesel fuel, the contractor is obliged to: a/supply of diesel fuel by transport of the contractor (tank), at the expense and risk of the contractor. b/ The tank should be equipped with a pump adapted to transport liquid fuel as well as a legalized measuring device for liquid fuel; c/supply of diesel successively, i.e. in batches. The one-time amount of diesel delivered will be at least 500 liters; d/delivery of diesel fuel within 48 hours from the moment of placing the order by the ordering party to the Contractor's e-mail address specifying the day of delivery of diesel oil and its quantity. e/deliveries will take place from Monday to Friday (on working days) from 7:00 to 14:00. In the case of placing an order on a Friday, or on the day preceding at least a two-day holiday period, the day of delivery will be on the first nearest business day; f/ Gas oil grade, determined depending on climatic conditions (period), should be in accordance with the delivery date pursuant to the PN-EN 590:2013 Standard.Supplies of gas oil in grades b, d, f (summer, transitional, winter), meeting the requirements of the applicable Polish Standard PN-EN 590 and the Regulation of the Minister of Economy of 9 October 2015 on quality requirements for liquid fuels (Journal of Laws No. U. of 2015. Item 1680), whereby, in accordance with applicable law, in the event of discrepancies, the Regulation has precedence; g/presentation at each delivery of the fuel quality certificate; h/provide, at the request of the contracting authority, a valid certificate of verification of the tank measuring device with the number consistent with the serial number of the meter installed on the delivery vehicle. 3. The basis for settlements will be the quantity of diesel fuel delivered according to the indications of the legalised measuring device converted into a quantity at a reference temperature of 15oC . 4. Failure to meet the condition of presenting a fuel quality certificate at the time of delivery will result in non-acceptance of the delivery and contractual penalties applied mutatis mutandis as for late deliveries for each case of failure to present a certificate. 5. The Contractor shall be liable to the Contracting Authority for defects in the diesel fuel which reduce its value or serviceability and, in the event of loss as a result, the Contractor undertakes to cover them. 6. Any order during the term of the contract of less or more diesel fuel will not change the margin and discount specified in the Offer Form, and for this reason the contractor will not be entitled to any additional claims against the ordering party. 7. The total quantities of diesel deliveries accepted by the contracting authority – 240 000 litres – are estimated quantities. The Ordering Party reserves the right to supply diesel fuel in the total estimated quantity: 40.000l depending on climatic conditions. 8. The Ordering Party reserves the right not to use all or part of the contract covered by the option right, and the Contractor declares that he will not make any claims for this reason. 9. All requirements included in the description of the subject of the contract also apply to the execution of the contract under the option right. The trade margin/price discount under the option right does not change in relation to the price discount/trade margin specified in the offer form. 10, The exercise of the option right by the Ordering Party shall take place on the basis of a written statement of the Ordering Party submitted to the Contractor at least 2 working days before the date on which the order covered by the option right is to be launched. 11.
