The subject of the contract is Delivery and installation together with the design and commissioning of 3 heat pump installations as part of applications for co-financing entitled: a) Development of distributed energy based on RES for public buildings in the Municipality of Zawiercie 2 b) Development of distributed energy based on RES for public buildings in the Municipality of Zawiercie 3. 2. The subject of the contract is delivery and installation together with the design and commissioning of 3 installations with an air heat pump: preparation of design documentation for 3 air heat pump installations for hot water or central heating in public buildings in the Commune of Zawiercie and delivery of installation elements and on-site installation of air heat pump installations based on the design documentation together with commissioning and instruction. There are 3 types of air heat pump installations, in quantities and locations: 1. Primary School No. 7 in Zawiercie 42400 Zawiercie ul. Educational 55 cascade heat pumps for CO 140 kW 2. Primary School No. 7 in Zawiercie 42400 Zawiercie ul. Educational 55 Heat source for CWU 14 kW 3. ZGM in Zawiercie 42400 Zawiercie ul. Commodity 30 Cascade heat pumps for CO 110 kW 3. A detailed description of the subject of the contract as well as a description of how to perform part of the contract can be found in the Functional Utility Program (PFU), which is an annex to the FTZ. 4. In accordance with the provisions of the Draft Provisions of the Agreement, the Ordering Party provided for a flat-rate settlement within the meaning of Article 632 of the Civil Code (for the design and execution of installations of a given type). 5. The scope of work includes: 5.1. disassembly works of sanitary installations disassembly of installations in the boiler room (piping and fittings). 5.2. construction works: a) construction of the foundation for the pump / cascade of air-water pumps, b) adaptation of the boiler room for the installation of the internal installation of the CWU heat pump and the cascade of pumps. c) construction of the foundation for buffer tanks in the boiler room 5.3. Sanitary work: a) Primary School No. 7 installation of a cascade of air-to-water heat pumps with a total power of at least 140 kW for the purposes of CO; installation of a heat pump with a minimum power of 14 kW for the purposes of CWU; installation (assembly of CO buffers, CWU installation of distributors, piping and fittings); adaptation of the boiler room for the purposes of internal instrumentation of the PC installation (including, the installation of water, CO and CWU installation); b) Housing Management Plant installation of a cascade of air-to-water heat pumps with a total power of at least 110 kW for the purposes of CO; installation (assembly of CO buffers, CWU installation of distributors, piping and fittings); adaptation of the boiler room for the purposes of internal instrumentation of the PC installation (including, the installation of a drain, CO and CWU installation); construction of a foundation for buffer tanks and CWU in the boiler room 5.4. electrical works execution of a new electrical installation and a distributor for the needs of heat pump cas. 6. At the same time, the Ordering Party informs that in accordance with the provisions of the Draft Terms of the Agreement, it will require the Contractor selected in the proceedings for the duration of the contract to establish insurance cover (in accordance with the rules set out in the Draft Terms of the Agreement) and to lodge a security for the proper performance of the contract, in accordance with the content of this TMS. 7. The Ordering Party shall require the Contractor to provide a guarantee for the construction and assembly works, equipment and installations, heat pumps and other equipment of the installation for a period of at least 5 years from the date of signing by the Ordering Party of the faultless protocol for final acceptance of the subject of the contract. 8. The equipment, installations and facilities constructed shall have a durable and reliable structure. The delivered devices must be unused and brand new come from serial production taking into account the configuration options provided by the manufacturer for the offered model of equipment and come from the official distribution channel for the Polish market. The ordering party does not allow the supply of equipment that is a prototype, and the technology used and its individual elements should be checked in operational practice. The Contractor's tasks include carrying out tests and mandatory checks in the light of applicable law and property protection within the construction site. 9. Time to rectify the failure – up to 5 working days from the moment of their notification on working days from 7: 00 to 15:00. 10. Response time to a service request – up to 24 hours from the moment of notification on working days from 7:00 to 15:00 on the terms resulting from the Agreement. 11. Where a trade mark (brand), patent or origin, source or specific process which characterises the products or services provided by a specific Contractor or where the standards, technical assessments, technical specifications and technical reference systems referred to in Art. 1 point 2 and paragraph. 3 of the Act, the Employer in accordance with Art. 5 of the Act allows the submission of an equivalent offer or in accordance with Art. 4 of the Act offering solutions ‘equivalent’ to those indicated in the description of the subject-matter of the contract, provided that they ensure that technical parameters are not inferior to those laid down in the FTZ, including PFU.
