Preparation of the project documentation for the development consent (DPZ), which will contain in the document part all the documents necessary for the issuance of the development consent. Part of the DPZ will also be a discussion with all DOSS (concerned state administration bodies) and pre-project preparation including all necessary construction-technical surveys (e.g. geological and geotechnical survey, hydrogeological survey, etc.) and other additional measurements that will lead to a faultless work. Documentation for the development consent must comply with the requirements of Act No 283/2021, the Building Act, as amended (‘the Building Act’), Decree No 146/2024, on construction requirements, and Decree No 131/2024, on building documentation, as amended. The scope of the individual parts of the documentation must correspond to the type and importance of the investment project, its location, technical construction, purpose of use, impact on the environment and duration of the construction. Performance of related engineering and investment activities (in particular securing the opinions of the concerned state administration bodies, network owners, etc.). The performance of engineering and investment activities involves, on the part of the contractor, the negotiation of project documentation for the project permit procedure with the relevant authorities and state administration organisations, i.e. the provision of opinions for the issue of the project permit, the submission of an application to the building authority and the processing of the project permit, including the acquisition of legal force. 2. Preparation of project documentation for the execution of the construction, including an inventory of works, supplies and services, including a statement of acreage (documentation for the selection of the contractor) (hereinafter also referred to as ‘PDPS’), which will be used in the procurement procedure pursuant to the PPA and pursuant to the relevant implementing legislation and which contains, in particular, the elements pursuant to valid and effective legislation relating to its content relating to the subject of performance, in particular the Building Act, related legislation, a detailed inventory of works, supplies and services with a statement of acreage broken down into individual buildings and operating sets and stages, including also ancillary and other costs pursuant to Decree No 169/2016, an awarded inventory of works, supplies and services – itemised budget using aggregated (cumulated) items for repeated large-volume items with a breakdown of content, itemised budget must be prepared in such a way that their items are linked to the selected price system to the maximum extent. The TSO must be eligible to form part of the tender documentation of the public works contract in the details necessary for the processing of the tender for the public contract, i.e. in the details required by the PPA and its implementing regulations, in particular by Decree No 169/2016 on the determination of the scope of the documentation of the public works contract and the inventory of works, supplies and services with a statement of assessment, as amended. Account must be taken, inter alia, of the provisions of Section 36(1) of the PPA (prohibition of laying down tender specifications in such a way as to guarantee, directly or indirectly, a competitive advantage to certain suppliers without justification or to create unjustified obstacles to competition), the provisions of Section 89(5) of the PPA (prohibition of laying down technical specifications in such a way as to favour or disadvantage certain suppliers or products; prohibition of references to specific products). 3. Provision of an exclusive licence for the use of project documentation pursuant to Act No 89/2012, the Civil Code, as amended (‘the Civil Code’), and Act No 121/2000 on copyright, rights related to copyright and amending certain acts (the Copyright Act), as amended (‘the Copyright Act’), i.e. unrestricted consent to the use of the work so that the contracting authority is entitled to dispose of the work freely, at its discretion and without restriction. 4. Providing cooperation and technical assistance in the procurement procedure for the contractor under the PPA. During this phase, the contractor will provide the contracting authority with answers to the participants’ questions relating to the project documentation as part of the explanation of the procurement documents during the implementation of the procurement procedure for the selection of the contractor under the PPA. Inquiries from participants, i.e. requests for clarification of tender documentation related to project documentation, shall be transmitted by the contracting authority to the contractor in electronic form, the contractor shall prepare expert responses to participants’ questions, i.e. it shall submit explanations of tender documentation within 3 working days at the latest, regardless of the scope and complexity of the material content, and shall send them in electronic form to the contracting authority. 5. The performance of copyright supervision during the construction of a building on the basis of project documentation pursuant to Section 14(h) and Section 161(2) of the Construction Act (hereinafter also referred to as the ‘Execution of Copyright Supervision’).
