1.The subject of the contract includes 50 parts. PART NO. 1 PROGRAMME MEDICINES, PART NO. 2-35 BASIC MEDICINES, PART NO. 36-39 ANTIBIOTICS, PART NO. 40 NUTRITIONAL FEEDING, PART NO. 41 MEDICAL DEVICES, PART NO. 42 DIAGNOSTIC FACTOR, PART NO. 43-44 SPECIAL NUTRITION PREPARATIONS, PART NO. 45 CATHETIC DISINFECTION, PART NO. 46-50 BASIC MEDICINES. 2. The detailed scope of the contract is set out in Annex 2 to the SWZ – assortment and price form. Other conditions relating to the performance of the contract are set out in the draft provisions of the contract (PPU), which are Annex 6 to the SWZ. 3. All requirements specified in the documents indicated above are minimum requirements, and their fulfillment is mandatory. Failure to meet the above-mentioned minimum requirements will result in the rejection of the tender as inconsistent with the terms of the contract pursuant to Art. 1 point 5 of the Public Procurement Act. 4. The contracting authority shall allow partial tenders to be submitted. The term ‘partial tender’ shall mean the individual lots set out in Annex 2 to the SWZ. The contractor may submit a tender for any part or for the entire subject-matter of the contract. 5. Describing the subject-matter of the contract by reference to the standards, technical assessments, technical specifications and technical reference systems referred to in Art. 1 point 2 and sec. 3 of the Public Procurement Act, the Contracting Authority allows solutions equivalent to those described. In a situation where the Ordering Party indicates trademarks, patents or origin in the procurement documents, the Ordering Party allows the use of equivalent solutions. 6. The contracting authority provided in the contract notice that the selection of the most advantageous tender would be preceded by an electronic auction if at least 2 non-rejectable tenders were submitted in this procedure.
