Description

1. The Contractor will either provide the time-limited licences of IMPERVA DAM valid from 17 December 2025 for 12 months (subscriptions) or provide and implement an equivalent solution. 2. Number of subscriptions to the System - 8 pcs. 3. The Contracting Authority informs that it has implemented the Database Activity Monitoring System - DAM based on the implementation of the IMPERVA DAM system. The subscription to the scheme ends on 17 December 2025. 4. Technical support of the DAM System Manufacturer will include in particular: a. telephone consultations, e-mail, access to the customer service portal in order to solve problems encountered during the operation of the System, assistance in the application of device configuration solutions, within 12 months from the date of signing the contract, b. access to technical assistance 24x7x365. Number of authorized contacts with the technical assistance of the System manufacturer - unlimited, c. possibility to report problems with the System 24 hours 7 days a week, d. access to support and service engineers through the following communication channels: e-mail, web portal, telephone, 5. The technical assistance provided by the Contractor with regard to the operation of the DAM System shall include, in particular: a. dimension: Minimum of 2 hours per month. Unused consultation hours go to the following months, b. availability: working days from 7:30 to 15:30 except public holidays and public holidays, c. Place: the seat of the Ordering Party or in agreement with the Ordering Party remotely, d. performance of tasks resulting from the scope of the contract, including, but not limited to: • removing critical, serious and low-category errors, • monitoring and ensuring system availability, • responding to security incidents, • updating and technical support. 6. A detailed description of the subject-matter of the contract and the manner in which the contract is to be performed are set out in Annex 1 to the FTZ – Description of the subject-matter of the contract and in Annex 3 to the FTZ – Essential provisions. 7. If the procurement documents indicate, in relation to certain materials or equipment, trademarks, patents or origin – the Contracting Authority, in accordance with Art. 5 PZP, allows the offering of equivalent materials or devices. Materials or devices from specific manufacturers shall specify the minimum quality parameters, performance characteristics, which must be met by materials or devices offered by the Contractor in order to meet the requirements set by the Ordering Party. Materials and equipment from specific manufacturers are only a quality model of the subject-matter of the contract. By ‘minimum quality parameters and performance characteristics’, the contracting authority understands the requirements for materials or equipment contained in publicly available sources, catalogues, manufacturers’ websites. The use of exemplary manufacturer names is aimed at clarifying the level of expectations of the Ordering Party in relation to a specific solution. The use of product/producer names is purely illustrative. The Ordering Party indicating the designation of a specific manufacturer (supplier) or a specific product in the description of the subject of the contract, at the same time allows equivalent products with performance and quality characteristics at least at the level of the parameters of the indicated product, thereby recognising any product with indicated or better parameters. 8. Whenever the Contracting Authority describes the subject-matter of the contract by reference to standards, European technical assessments, approvals, technical specifications and technical reference systems, it shall allow solutions equivalent to those described. 9. Whenever a specific label or certificate referred to in Articles 104 and 105 of the PPL is used in the FTZ or in the procurement documents, the Contracting Authority shall also accept all other markings confirming that the works, supplies or services meet equivalent requirements. 10. In cases where the Contractor, for reasons beyond his control, is unable to obtain the label or certificate specified by the Employer confirming that the works, supplies or services offered by him meet equivalent requirements, the Employer shall, within the time limit specified by him, accept other means of proof, in particular the technical documentation of the manufacturer, provided that the Contractor proves that the works, supplies or services offered by him meet the requirements of the specific marking or specific requirements indicated by the Employer. 11. The use in the FTZ or procurement documents of the requirement to have a certificate issued by a conformity assessment body or a test report carried out by that body as a means of proof of compliance with the requirements or characteristics set out in the description of the subject-matter of the contract, the tender evaluation criteria or the contract performance conditions means that the Contracting Authority also accepts certificates issued by other equivalent conformity assessment bodies. The contracting authority shall also accept other appropriate means of proof, in particular the technical documentation of the manufacturer, where the Contractor concerned has neither access to the certificates or test reports nor the possibility of obtaining them in good time, provided that such lack of access cannot be attributed to the Contractor concerned and provided that the Contractor concerned proves that the works, supplies or services which he performs meet the requirements or criteria set out in the description of the subject-matter of the contract, the criteria for evaluating the tenders or the conditions for performance of the contract. 12. Describing the subject-matter of the contract by reference to the standards, technical assessments, technical specifications and technical reference systems referred to in Art. 1 point 2 and paragraph. 3 PPL, the Ordering Party allows solutions equivalent to those described. 13.
