Legal basis for the use of the direct award procedure: In accordance with the provisions of Art. 1 point 6 of the Public Procurement Act, the Contracting Authority may award the contract directly if: no request to participate was received in the procedure previously conducted in an open or restricted procedure or all requests to participate were rejected pursuant to Art. 1 point 2 or no tenders were submitted or all tenders were rejected pursuant to Art. 1 point 2 or, due to their non-compliance with the description of the subject of the contract, pursuant to Art. 1(5) and the original terms of the contract have not been substantially altered. Actual basis for the use of the direct order mode: The contracting authority conducted the procedure under reference SSM.DZP.200.35.2026 in the form of an open tender, in accordance with Article 132 et seq. of the Public Procurement Law Act of 11 September 2019 (consolidated text: Journal of Laws Journal of Laws 2024, item 1320, of 2025, item 620, as amended) for the supply and installation of brand new office and social equipment intended to ensure appropriate organisational and working conditions for staff providing health services in the field of cardiology, including diagnosis, treatment and monitoring of patients with cardiovascular diseases, broken down into the following parts: Part I – Supply and installation of office chairs; Part II – Supply and installation of office furniture; Part III – Delivery and installation of desks; Part IV – Delivery and installation of locker rooms. The contracting authority allowed partial tenders to be submitted for one or more lots. The tenders were opened on 13.03.2026 at 13:00, no tender for individual parts was received within the deadline set by the Ordering Party, therefore the Ordering Party annulled the procedure pursuant to Article 255 point. 1 of the Public Procurement Act of 24 March 2026. The subject of the contract is the purchase and supply of brand new office and social equipment: Part 1 – Supply and assembly of desks Part 2 – Supply and assembly of office furniture. A detailed description of the subject-matter of the contract for each lot, including technical, functional, quantitative, qualitative and regulatory requirements, is set out in Annex 1 to the invitation to tender for: Part 1 – supply and assembly of 4 desks, Part 2 – supply and assembly of 1 set of office furniture, which are also assortment and price forms.
