Description

Pursuant to Article 114 of the Public Procurement Act, due to the lack of secured funding at the opening of the procedure, the Contracting Authority makes the performance of the contract conditional. Execution begins after confirmation by the Assignor of secured funding and presentation by the Contractor of the specified performance guarantee. In case of failure to present the performance guarantee within the term specified by the Assignor, without the presence of objective reasons, the contract shall be terminated. Where funding is not provided after a period of three months from the conclusion of the contract, either party may request its termination without notice. If, after a period of 10 months from the conclusion of the contract, no financing is provided, the contract shall be considered terminated.
