3. Terms of delivery: a) Refueling of vehicles and purchase of consumables - non-cash at the Contractor's service station. b) Location of the service station: - Task No 1 - in the city of Biłgoraj - Task No 2 - in the city of Józefów - Task No 3 - in the city of Zamość c) Issuing a driver after each refuelling of a document confirming the fact of taking fuel for a company car or equipment and consumables, containing: Fuel card number, time, date of execution of the above-mentioned with confirmation of refueling or purchase in the road card / daily report. d) The Ordering Party allows the registration and settlement of collected fuels and consumables using micro-processor fuel cards, provided that their use will be in accordance with the provisions of the contract and that the Ordering Party will not bear additional costs related to their issue and operation. e) Fuels must meet the requirements set out in the Regulation of the Minister for Climate and the Environment of 26 June 2024 on quality requirements for liquid fuels (Journal of Laws No. U of 2024, item 1018). 4. The Contractor shall be remunerated for the actual quantities delivered. 5. The order must be made in accordance with the description of the subject of the order. 6. In accordance with Art. 1 of the Public Procurement Act was divided into lots due to the fact that the road circuits are distant from each other (it is about the shortest possible time for the vehicle to reach the service station). The Contracting Authority accepts the possibility of submitting partial tenders, the Contractor may submit a tender for one or more tasks, from among the tasks selected by him: Task No 1 – Supply of liquid fuels and consumables for vehicles and service equipment – Biłgoraj Road District, Task No 2 – Supply of liquid fuels and consumables for vehicles and service equipment – Józefów Road District, Task No 3 – Supply of liquid fuels and consumables for vehicles and service equipment – Zamość Road District. 7. Whenever the description of the subject-matter of the contract is described by means of standards, the contracting authority shall allow solutions equivalent to those described, it shall be presumed that each reference to the technical specifications and standards is accompanied by the words ‘or equivalent’. 8. The subject of the contract is described in the manner specified in Art. 1 point 2 and paragraph. 3, the PPL Act. The Contracting Authority shall accept solutions equivalent to those described, provided that the Contractor proves in the tender, in particular by the means of evidence referred to in Articles 104 to 107, that the proposed solutions meet the requirements specified in the description of the subject of the contract to an equivalent extent. 9. The Ordering Party allows the supply of liquid fuels meeting the requirements other than those specified in the Regulation of the Minister for Climate and the Environment of 26 June 2024 (Journal of Laws of 2024, No. U 2024 poz.1018), while the parameters contained therein must meet at least the requirements set out in the above-mentioned Regulation. 10. The contracting authority, in accordance with Art. 1 of the Public Procurement Act, will first examine and evaluate the tenders, and then make a qualitative selection of the Contractor whose tender was the highest rated, in terms of the lack of grounds for exclusion and compliance with the conditions for participation in the procedure. 11. In accordance with Article 433(4) of the Public Procurement Act, the Contracting Authority indicates that: a) For task 1 - the minimum amount of the benefit referred to in point IV.2.1) is 15%, b) For task 2 - the minimum amount of the benefit referred to in point IV.2.2) is 15%, c) For task 3 - the minimum amount of the benefit referred to in point IV.2.3) is 15%. 12. It is possible to cancel the procedure following the non-allocation of funds to finance the contract. Pursuant to Article 257 of the Public Procurement Act, the contracting authority may cancel the procurement procedure if the public funds that the contracting authority intended to allocate to finance all or part of the contract have not been granted to it.
