1.The subject of the order is the supply of green hydrogen marked CN28041000, intended for the propulsion of 11 public transport buses in the amount of 95 940 kg in the period of 24 months, i.e. from 01.01.2026 to 31.12.2027 (basic order). The Ordering Party reserves the right to purchase a smaller amount of hydrogen than indicated above, in accordance with current operational needs, with the minimum amount of hydrogen to be purchased under the basic order set at 80 000 kg. If it is not used by the end date of the contract, it is not obliged to exhaust the full quantity indicated above. 2.The Customer's daily demand for hydrogen is about 200 kg ± 20%. 3. The hydrogen offered (both in the basic contract and in the optional contract) must be green, i.e. produced using energy from renewable sources. The Contractor shall provide the Ordering Party with a statement, certificate, guarantee of origin or other document confirming that the hydrogen supplied is hydrogen produced using renewable energy sources at each request of the Ordering Party and within a period specified by the Ordering Party, but not longer than 7 days from the date of delivery of the request. The Contractor shall attach to the tender his own declaration that the hydrogen offered is green hydrogen. 4. The contracting authority envisages the possibility of extending the contract under the option for another 24 months, i.e. for the period from 01.01.2028 to 31.12.2029, with a demand of approximately 102 240 kg of hydrogen. The Ordering Party reserves the right to purchase a smaller amount of hydrogen than indicated above, in accordance with current operational needs, with the minimum amount of hydrogen to be purchased under the basic contract being set at 80 000 kg. If it is not used by the end date of the contract, it is not obliged to exhaust the full quantity indicated above. 5.Daily demand of the Ordering Party for hydrogen in the scope of the optional order is about 200 kg ± 20%. Pursuant to Article 139 of the Public Procurement Act (reverse procedure), the Contracting Authority will first assess the tenders and then examine whether the Contractor whose tender has been assessed as the most advantageous is not excluded and meets the conditions for participation in the procedure.
