1. The subject of the contract ‘Reception and management of municipal waste from owners of real estate residing in the Commune of Hardwice and from municipal public facilities and waste from the municipal cemetery in 2026 and 2027’. 2. The contract was divided into 2 lots: PART I – ‘Reception and management of municipal waste from owners of real estate residing in the Commune of Hardwice’. PART II – ‘Reception and management of municipal waste from municipal public facilities and waste from the municipal cemetery’. PART I – ‘HOLDING AND MANAGEMENT OF COMMUNITY WASTE FROM PROPERTY OWNERS PARTICIPATING IN THE COMMUNITY OF HARVEST’. 1) The subject of the contract is a service consisting in the collection and management of municipal waste collected from owners from residential properties and cottages or other properties used for recreational and leisure purposes, located in the Commune of Hardwice, i.e. from parishes: Hardwice, Bogoniowice, Bruśnik, Falkowa, Jastrzębia, Ostrusza, Kipszna, Kąśna Dolna, Kąśna Górna, Pławna, Siekierczyna, Tursko, Zborowice. Receipt and management should be carried out in such a way as to ensure that appropriate levels of recycling, preparation for re-use and recovery by other methods are achieved and that the weight of biodegradable municipal waste transferred to landfill is reduced, in accordance with the Act of 13 September 1996 on maintaining cleanliness and order in municipalities (Journal of Laws of 1996, No. Journal of Laws 2024, item 399), the provisions of the Waste Management Plan of the Malopolska Region, and in accordance with the Regulations for maintaining cleanliness and order in the Commune of Hardwice in force during the contract and the resolution of the Town Council in Hardwice on the detailed method and provision of services in the field of collecting municipal waste from property owners and managing this waste. The subject of the contract for its comprehensiveness also includes the service of equipping the property with waste collection bags with individual QR codes. 2) The service of collecting and managing municipal waste will be carried out in accordance with: 2.1 Applicable laws, in particular:  Act of 13 September 1996 on the maintenance of cleanliness and order in municipalities (Journal of Laws No 2025, item 733, as amended), hereinafter referred to as the ‘Ucpg’,  Act of 14 December 2012 on waste (Journal of Laws No 2023, item 1587, as amended),  Act of 27 April 2001 – Environmental Protection Law (Journal of Laws No 2025.647, as amended). 2.2 Regulations for maintaining cleanliness and order in the area of the Commune of Hardwice and other Resolutions of the Town Council in Hardwice regarding the waste management system in force during the term of the contract. 2.3 The current Provincial Waste Management Plan. 3) Numerical data helpful in order valuation: 3.1 The area of the Commune of Hardwice is 103 km2, including a built-up area of 10.67 km2. 3.2 The number of persons permanently registered in the Commune of Hardwice as at 18.09.2025 amounted to 11 124 persons, temporary - 138, total - 11 246 persons. 3.3 The number of inhabitants according to the declaration on the amount of the municipal waste management fee as at 01.01.2025 amounted to 8,765 people, while as at 18.09.2025 it amounted to 8,807 people. 3.4 The estimated number of residential properties according to the declaration on the amount of the waste management fee is 3052, while the planned increase in the number of properties during the term of the contract will not exceed 1.5% and this will not entail a change in remuneration. 3.5 The estimated number of properties with difficult access to the property – 8% of the total inhabited property, and it is recommended to carry out an on-site inspection at the place of performance of the subject-matter of the contract, in order to estimate, on their own responsibility, the costs and risks of performance of the contract and to obtain all data that may be necessary for the reliable preparation of the tender. PART II – ‘HOLDING AND MANAGEMENT OF COMMUNITY WASTE FROM MUNICIPAL PUBLIC FACILITIES AND WASTE FROM THE COMMUNITY CMENTAR’. 1) The subject of the contract is the provision of comprehensive services for the collection and management of municipal waste from municipal public facilities and waste from the municipal cemetery in the Commune of Hardwice in 2026 and 2027, consisting in the collection and management of municipal waste from municipal public facilities and waste from the municipal cemetery in the Commune of Hardwice. As part of this contract, the Contracting Authority provides for the possibility of exercising the right of option referred to in Article 441 sec. 1 PZP, in the scope and quantity provided for by the Ordering Party: 1) increasing the number of days of service provision in a quantity not exceeding 20% of the basic order for each part of the order.
