Description

1. The subject of the contract is the successive delivery of medicines to the Franciszek Raszei Municipal Hospital in Poznań. 2. A detailed description of the subject of the contract containing information about the assortment, quantities and its technical and usage parameters is set out in Annex 2 to the SWZ, which is an integral part of it. 3. A detailed description of the requirements for the subject-matter of the contract is described in Chapter III of the SWZ. 4. N.B.: Applicable for packages 25, 26 and 27 (Target import medicines): For packages Nos 25, 26 and 27, deliveries may be made as part of the final import on the basis of Article 4 of the Pharmaceutical Law Act. Obtaining appropriate consent for import is the responsibility of the Ordering Party. The trade name of the drug offered must be consistent with the order, which will each time constitute a need to import a medicinal product from abroad to save the life or health of the patient registered and numbered by the Ministry of Health and sent to the Contractor by the Hospital Pharmacy. 5. The contracting authority shall allow partial tenders to be submitted. 6. The order has been divided into 27 lots/packages. Each lot/package is a separate subject of the contract. Tenders may be submitted for one or more lots/packages. The minimum offer range is one full part/package, incomplete offers will be rejected. 7. In the event that in any document constituting part of the description of the subject-matter of the contract there are indications of trademarks, patents or origin, source or a particular process that characterizes the products or services provided by a particular Contractor (if this could lead to the preference or elimination of certain Contractors or their products), it should be understood, in accordance with the provision of Article 99 para. 5 of the Public Procurement Law that the Contracting Authority cannot describe the subject of the contract in a sufficiently precise and intelligible manner. In such circumstances, the Contracting Authority allows the possibility of submitting equivalent solutions in the tender, indicating that the minimum requirements to be met by equivalent solutions are requirements not inferior to the parameters indicated in these documents, and their criteria for assessing equivalence are indicated in the description of the subject of the contract. If the Contracting Authority has indicated trademarks, patents, origins or sources as well as standards, technical approvals and reference systems in the description of the subject of the contract, it is permissible to offer solutions equivalent to those described, provided that they maintain the same minimum technical, quality and functional parameters, etc. The Contractor who refers to equivalent solutions described by the Contracting Authority is obliged to indicate that the subject of the contract offered by him meets the requirements specified by the Contracting Authority. In the event that the Contracting Authority describes the subject of the contract by indicating trademarks, patents or origin, source or a specific process that characterizes the products or services provided by a particular Contractor, the Contracting Authority shall allow equivalent solutions. If the Contracting Authority describes the subject of the contract by reference to standards, technical assessments, technical specifications and technical reference systems referred to in Art. 1 point 2 and paragraph. 3 of the Act, the Contracting Authority allows solutions equivalent to those described. 8. The contracting authority shall allow equivalent tenders to be submitted. An equivalent offer consists in offering the same specificity, the international name of which corresponds to the contract underlying the description of the subject of the contract, i.e. medicines with the same chemical composition and international name, the same dose, form and therapeutic indication.
