1. The contracting authorities described in Chapter I of the SWZ jointly conduct a public procurement procedure (Article 38 of the Public Procurement Act), the authorised contracting authority – the Purchasing Group Leader – is the Chojnicki District. 2. The estimated amount of electricity to be procured is indicative and may differ from the amount actually consumed during the term of the contract. The amount of electricity was estimated on the basis of historical data on electricity consumption in the last 12 months and taking into account the actions taken by the procurers referred to in Article 37 of the Act of 7 October 2022 on special solutions for the protection of electricity customers in 2023 due to the situation on the electricity market and taking into account self-consumption in the case of customers with PV installations. Reducing or increasing the amount of electricity does not entail any consequences for the contracting authorities (customers) other than the need to pay for the amount of energy actually consumed. The rules for shaping and calculating tariffs and settlements in electricity trade are set out in the Regulation of the Minister for Climate and the Environment of 29 November 2022, as amended by the Regulation of the Minister for Climate and the Environment of 9 September 2023 amending the Regulation on the method of shaping and calculating tariffs and the method of settlements in electricity trade. 6. Details of electricity consumption are described in Annexes 1a/1b to the SWZ List of consumption points. 7. Back-up provider: 1) for PPE, where the DSO is ENERGA Operator S.A. as a reserve supplier, the ordering party indicates Energa-Obrót S.A. with its registered office in Gdańsk. 2) for PPE, where the DSO is ENEA Operator Sp. z o.o. as a reserve supplier, the contracting authorities indicate ENEA S.A. with its registered office in Poznań. 3) for PPE, where the DSO is PGE Energetyka Kolejowa S.A. as a reserve supplier, the contracting authorities indicate PGE Energetyka Kolejowa S.A. with its registered office in Warsaw. 8. Applicable tax periods: On the premises of ENEA Operator Sp. z o. o. and ENERGA Operator S.A.: Tariff group B, C2x – 1 month Tariff group C1x, G, R – 2 months On the premises of PGE Energetyka Kolejowa S.A. – 1 month 9. The Contractor, on the basis of the Power of Attorney granted, will be obliged to submit the contract on his own behalf and on behalf of the ordering party (recipients) to the relevant DSO in accordance with the applicable regulations and to represent him before the DSO in the process of changing the seller. 10. Distribution services are/will be provided on the basis of separate agreements concluded between contracting authorities (electricity customers) and DSOs. 11. Distribution system operator – as described in Annex 1a and 1b to the SWZ, column ‘Distribution System Operator’. The Contracting Authority shall apply Article 139 para. 1 of the Public Procurement Act, i.e., in the first place, it will examine and evaluate the tenders, and then it will make a qualitative selection of the contractor whose tender was the highest rated, as regards the lack of grounds for exclusion and compliance with the conditions for participation in the procedure.
