Poland-Lublin: Chromatographs
1. The subject-matter of the contract is the supply of the chromatography apparatus included in the project entitled “Adaptation and support of innovative scientific research laboratories of the Collegium Pathologicum of the Medical University of Lublin” (hereinafter also referred to as the subject of the contract/equipment) defined as follows:
(a) The contract covers the supply of:
— Electrochemical detector – 1 set;
— Chromatograph pumps integrated with a 4-channel vacuum gasifier – 1 set;
(b) A detailed description of the requirements relating to the subject-matter of the contract (equipment), warranty, servicing and training is set out in Annex 6 to the ToR – ‘Detailed description of the subject-matter of the contract’;
(C) the subject of the contract offered by the Contractors must meet the requirements set out in Annex 6 to the ToR ‘Detailed description of the subject-matter of the contract’;
2. The Contracting Authority reserves the right to cancel a public procurement procedure if funds from the budget of the European Union which the Contracting Authority intends to use to finance the contract are not awarded.

Requirements relating to the subject-matter of the contract(s):
4. The contracting authority requires new, complete equipment which, once installed, will be ready for use without the need for any additional purchase and investment.
5. The subject-matter of the contract consists of an assembly consisting of: delivery of equipment to the installation site, unpackaging, installation, connection to appropriate installations, checking, carrying out the required tests and measurements, putting into service the equipment.
Equivalent arrangements:
6. Whenever standards, trademarks, patents or origin are indicated in the description of the subject-matter of the contract in the tender specifications, the Contracting Authority shall allow equivalent solutions.
7. An economic operator who invokes an equivalent solution must prove that the subject-matter of the contract he offers meets the requirements laid down by the Contracting Authority.
8. The Contracting Authority considers equivalent to those whose functions and technical and performance are identical or not worse than those indicated in Annex 6 to the ToR – Detailed description of the subject-matter of the contract and which meet all the requirements of the Contracting Authority set out in Annex 6 to the ToR.
9. In the event of doubts on the part of the Contracting Authority concerning the determination of the equivalence of the tender submitted, all obligations relating to the confirmation of equivalence are incumbent on the Contractor (including the costs of any expert opinions).
