Description

1. The object of the contract is to perform the 24/7 protection of the market hall located at the street. Bonifacego 4 in Warsaw, which is part of the administration of the Mokoty Management Plant and maintaining order and cleanliness in the hall and in the area adjacent to it from 31 December 2010 from 31 December 2010 onwards. 7:00 no later than 30/12/2011 7:00
Stands in the hall are rented and traded from Monday to Friday from 7:00 to 19:00 and on Saturdays from 7:00 to 15:00. The contracting authority shall allow trade in the hall on pre-travel commercial Sundays and other days if necessary to open the hall between 7:00 and 15:00, with a maximum of 12 additional opening days for the trading of the hall for the duration of the contract to be signed as a result of the outcome of this procedure. The protection is to consist of 24 hours’ physical protection of the Contracting Authority’s property – i.e. the above-mentioned market hall, excluding boxes which have been rented from the Contracting Authority or will be rented from the Contracting Authority during the term of the above-mentioned contract and the goods in them. Protection is also to be based on the continuous safeguarding of security and public order in the area of the hall. With regard to the protection of property, the Contractor shall, in general, take measures to prevent criminal offences and offences against property designated for protection, and to prevent damage caused by such events and to prevent unauthorised persons from entering the protected area. As regards the 24/7 maintenance of order in the hall and in the area adjacent to it, the Contractor is required to ensure the day-to-day maintenance of order and cleanliness in the hall and in the area adjacent to it on all days of the week.
1.1. Protection will be carried out on a continuous basis – 24 hours a day of the week – from 7:00 to 7:00 hours, with:
Monday to Friday: in the form of a single-person station between 7:00 and 20:00 and a two-person post at 20:00 noon. 7:00 the following day,
On Saturdays: in the form of a single-person station between 7:00 and 16:00 and a two-person post at 4 p.m. until 1 p.m. 7:00 the following day,
1.1.3. on Sundays, holidays and other days on which the hall will be closed: in the form of a two-person station 24/7 (Monday until 1 p.m. 700 or another working day),
1.1.4. on commercial Sundays for the foreground and other days in the event of the opening of the hall: in the form of a single-person station between 7:00 and 16:00 and a two-person post at 4 p.m. until 1 p.m. 7:00 the following day;
1.2. The contracting authority reserves the right to modify the method and term of protection and cleaning referred to in points 3.1.1.3 and 3.1.1.4. and 3.1. of the specification in order to allow trade in the hall on the pre-travel commercial Sundays and other days if necessary to open the hall between 7:00 and 15:00, with a maximum of 12 additional opening days for the trading of the hall during the period of validity of this contract;
1.3. the protection referred to in point 3.1. will be carried out through the Contractor’s staff in a uniform with the name of each badge, equipped with wireless communication means, anti-tamper buttons – operating by radio waves and torches, and by motorised intervention patrols;
1.4. The protection referred to in point 3.1. will be carried out using a radio-contaminant system which the Contractor must have at its disposal during performance of the contract and wireless means. The contractor must undertake, within the price charged for the performance of the contract, to equip the hall with a radio-containment system for the duration of the contract, and its staff with anti-tampering buttons interoperable with the installed anti-pumping system and wireless means of communication. The Contractor will also be required to ensure the transmission of the alarm signal emitted by security staff from the protected emergency patrol facility which the Contractor must have at its disposal during the performance of the contract. The response time of the intervention patrol from the call for arrival shall not exceed 15 minutes per day and 8 minutes at night.
2. The Contractor’s obligations relating to the 24-hour protection referred to in point 3.1 of the specifications for the duration of the contract shall include, in particular:
2.1. Cause inside the protected building in order to check the correct closure of all windows, external doors, box doors and the condition of the protected facility outside the opening hours of the hall;
2.2. to celebrate the hall during its opening hours in order to safeguard public order and security on its premises and to safeguard the Contracting Authority’s assets;
2.3. immediate notification to the Police in the event of an attempt to commit or commit theft, burglary, seizure, devastation of property;
The immediate notification of the Rescue Emergency in the event of an accident, as well as an attempt to perpetrate or commit an attack, if necessary;
2.5. immediate notification to the Fire Service in the event of a fire or an arson test;
2.6. notifying the SPEC without delay in the event of a failure of the CO installation or the discovery of such a hazard;
2.7. immediate notification to the MPWiK in the event of a failure of the sewerage system or the occurrence of such a hazard;
2.8. immediately inform his employer, the Head of the ZGN Business Unit in the District – Mokots of Mr Stanisław Samoraj and the person representing the Contracting Authority in matters arising from the performance of the contract of any risks involved and of the inability of the staff member of the Contractor to perform his duties;
Opening and closing of exit doors, smoke flaps and extinguishing and ignition of light;
2.10. Check whether persons in the protected building outside the opening hours of the hall are entitled to do so;
2.11. Management of an on-call manual containing the name of the person on duty, the hours of duty, and the arrival of emergency patrols and records of cleaners;
2.12. keeping a directory – a personal traffic register containing the names of persons in the protected building outside the opening hours of the hall, together with the time of arrival and departure;
2.13. keeping a book – records of goods taken outside the opening hours of the hall;
2.14. take all other necessary steps to ensure the proper performance of the contract;
2.15. checks by the intervention crew shall be carried out at least 6 times between 19.00 and 7.00 on all days of the contract to check the condition of the protected facility.
3. In the cases referred to in points 3.2.3. to 3.2.7., it is also necessary to immediately inform the Director of the ZGN in the district of Mokotów m.st. Warsaw and the person designated by the Contracting Authority to work on matters arising from the performance of the contract.
4. The workers referred to in point 3.1.3. shall have appropriate uniforms and identifiers bearing the name of each of them, shall be equipped with wireless means of communication, radio-based anti-tampering buttons and electric torches. The scope of the contract does not cover the provision of gas or sharp weapons to the Contractor’s staff, so any fitting out of this equipment by the Contractor will be a cost to the Contractor for which the Contracting Authority will not pay.
5. During the term of the contract, the Contracting Authority reserves the right to call free of charge (not more than once a month) for an intervention patrol in order to verify the effectiveness of the security performance.
6. During the period covered by the contract, the Contractor’s obligations relating to the maintenance of order and cleanliness in the hall and its adjacent areas, as referred to in point 3.1 of the specifications, shall include in particular:
6.1. day-to-day cleaning of hall, corridors, passageways, propeller rooms, stairs in the hall by sweeping and washing and, in the case of floors, washing with mechanised equipment;
6.2. On-going, day-to-day maintenance of order and cleanness in all toilets located in the hall by:
Washing of lavatory shells, urinals and washbasins,
6.2.2. cleaning of floors, doors and glazing on walls,
6.2.3 Collection and dumping of pollutants,
The washing of fittings, mirrors and other equipment,
6.2.5. Filling of toilet paper and soap;
6.3. Clearing according to needs: glazing, windows and doors at all entrances to the hall;
6.4. maintaining order and cleanliness in the office located on hali tootres and in a room for day-to-day protection:
6.4.1. sweeping and washing of floors,
Cleaning of carpets,
Abrasion of dust from desks, cabinets, telephone sets and other equipment,
Cleaning of ashtrays,
Littering, and:
Washing of varnished furniture, parapets once a week,
Cleaning of doors, lamperies – once a month,
6.4.8. Flower watering – once a week,
Window cleaning on a quarterly basis;
6.5. maintenance of order and cleanliness in technical rooms, i.e. propeller, electrical switchboard, thermal node, water, air-conditioning by sweeping and floor washing and cleaning equipment/in accordance with needs/;
6.6. reporting to the property administrator any faults, failures and findings;
6.7. To check that hazardous materials, fire devices or other hazards have not been left in spaces other than rented boxes/after the opening hours of the hall;
6.8. maintaining order and cleanliness outside the building on the property by:
6.8.1. On-going removal of litter and other pollutants,
6.8.2. green maintenance,
During the winter period, the on-going snow, the prevention and elimination of the effects of the pigeons, the removal of soaps/snow must be carried out continuously during precipitation and be completed within 1 hour of the end of precipitation/, removal of excessively accumulated snow or ice from the roof of the hall. The cover of snow or ice on the roof shall not exceed 20 cm thick.
Note: water for economic purposes can only be drawn from catchment valves located in toilets.
Casual valves located in the market hall may not be used.
7. The cleaning referred to in point 3.6 will be carried out through the Contractor’s staff holding a badge bearing the name.
7.1. The number of cleaners employed to carry out the employment must be such that the hall and the land are fully cleaned after its closure and prepared for opening. During the working hours of the hall, a minimum of 1 cleaner is to be present on the hall to continuously remove contaminants and keep order, and to supplement soap and toilet paper in toilets. During the winter period, snow, prevent and eliminate the effects of pigeons, sprinkled with sand and remove soups.
7.2. The procurer provides toilet paper and soap and ground-sand sand. Other cleaning products and equipment – including mechanised equipment for cleaning floors – shall be provided by the Contractor.
7.3. The Contractor will be required to notify the Contracting Authority of the need to supply soap, toilet paper and sand for depositing the land three days in advance.
8. The Contractor’s detailed responsibilities are set out in the essential provisions of the contract, which constitute Chapter III of the tender specifications.
9. The activities referred to in points 3.1 to 3.7 of the specifications are to be carried out in accordance with the terms of the relevant provisions of the contract, which constitute Chapter III of the tender specifications.
9.1. The contracting authority reserves the right to amend the provisions of the contract concluded as a result of the termination of the procedure in question, provided that such changes are, inter alia, subject to circumstances which could not have been foreseen at the time of conclusion of the contract or are favourable to the Contracting Authority and in the event of a change in the legal order, as well as amendments to the tender specifications, including:
9.1.1. The contracting authority reserves the option of not providing part of the services covered by the contract;
During the performance of the contract, the Contractor may modify the Subcontractors if, for reasons which could not have been foreseen at the time of conclusion of the contract, it is necessary for the Contractor to use new subcontractors to carry out part or all of the scope previously entrusted to other subcontractors for proper performance of the contract;
9.1.3. if it is necessary to provide services which are not provided for in the description of the subject-matter of the contract, the Contractor must perform them on a separate instruction from the Contracting Authority. The value of the additional services may not exceed 50 % of the value of the contract to be performed;
9.1.4. changes in the VAT rate;
9.1.5. reduction of the budgetary resources for the execution of the contract;
9.1.6. limitations of material and financial scope;
Changes in the persons involved in the implementation of the subject matter of the contract;
Changes to the scope of parts of the subject-matter of the contract entrusted to the contractors;
Changes to the required reporting and settlement of the costs of performance of the subject matter of the contract;
9.1.10. Amendments to the legislation in force after the date of conclusion of the contract, including the effects of such a change in the regulatory framework;
9.1.11. Changes in the method and duration of protection, reduction or increase of the number of protected buildings during contract implementation and change of site addresses.
10. The Contractor will be required to:
10.1. possession of a paid policy or other insurance document for an amount not less than the equivalent of PLN 2 000 000,00, confirming that he is insured against civil liability in respect of his business activity, including the subject matter of the contract;
The lodging of a performance guarantee in accordance with the conditions laid down in point 22 of the specifications.
11. The contracting authority does not provide for advance payments for the performance of the contract.
14. The contracting authority shall provide for the possibility of awarding complementary contracts representing not more than 50 % of the value of the basic contract referred to in Article 67(1). 1(6) of the Public Procurement Act, consisting of the repetition of the same type of contracts for the provision of security and cleaning services, in the area administered by the ZGN in the district of Mokotów in Warsaw.
