Supply of disposable medical equipment
1. The subject of the contract is: Supply of disposable medical equipment: The order consists of 28 parts. 2. Detailed descriptions of the subject of the contract, including descriptions of the minimum requirements are contained in the Price Forms appendices No. 1.2 - 1.29. to the Offer Form. 3. The Contracting Authority allows the Contractor to entrust the performance of part of the contract to subcontractors (with whom it has concluded a subcontract as defined in Art. 27 p.p. In this case, the Contractor is obliged to indicate in its tender the parts of the contract (scope) which it intends to entrust to subcontractors and to provide the full names and data of subcontractors by the Contractor. If the Contractor entrusts the performance of the contract to a subcontractor, he shall be liable for the acts and omissions of such an entity as his own. The contractor must indicate in the SEDZ in Part II, Section D, the lots it intends to subcontract and, if already known, the subcontractors’ companies. 4. The subject of the contract must be performed in accordance with the applicable Polish Standards and other legal provisions regulating the requirements in terms of ergonomics, safety and appropriate quality. 5. The subject-matter of the contract must be placed on the market and put into service in accordance with the rules applicable to hospitals. 6. Submission of partial tenders is permitted. Number of parts: 28. Tenders or requests to participate may be submitted in respect of: all parts. Tenders which do not cover all the constituent elements of the subject-matter of the contract within a given lot will be rejected. 7. The Contractor is obliged to execute the order on the terms and conditions described in the FTZ and the offer. 8. Place of performance of the contract: the seat of the Ordering Party Namysłowskie Centrum Zdrowia Sp. z o.o., ul. Oleśnicka 4, 46-100 Namysłów – (hospital pharmacy). 9. Contractors are responsible for carefully acquainting themselves with the FTZ and its annexes, any amendments to the FTZ made during the tendering period and for obtaining reliable information regarding the various conditions and obligations which may in any way affect the sum or substance of the tender or the performance of the supplies. 10. Contractors submitting tenders are obliged to familiarize themselves with the relevant laws, acts and regulations in force in Poland, which in any way may affect or refer to actions taken in connection with the tender and following the signing of the contract. 11. The Contractor is obliged to complete the delivery in an absolute and timely manner. 12. The contracting authority shall provide for the application of the right of option. During the term of the contract, the Ordering Party reserves the right of option, which includes the right to increase by 10% the quantity of each of the assortment items at unit prices and under the conditions resulting from the provisions of the contract. The Ordering Party is not obliged to exercise the right of option. The contracting authority may exercise the option right partially, or may exercise the option right gradually, until the maximum scope of the contract taking into account the exercise of the option right is reached. The terms of supply covered by the option right shall be the same as the terms of supply covered by the basic contract.
