As part of the implementation of the subject of the contract, the Contractor undertakes to: 1) delivery to the Ordering Party of Buses with electronic equipment (equipment and systems installed in buses), necessary software and equipment for its operation meeting the requirements set out in Attachments No. 1 to the Draft provisions of the contract; 2) providing the necessary technical documentation specified in Annex No. 1 to the Draft provisions of the contract; 3) conducting training to the extent necessary for the proper use of the subject of the contract - on the terms described in Appendix No. 1 to the Designed provisions of the contract, 4) granting a quality guarantee for Buses with equipment and a guarantee for software on the terms described in Appendix No. 4 to the Designed provisions of the contract. If, in the period between the submission of an offer by the Contractor in the procurement procedure and the performance of the Contract, there is a change in the law regarding the registration, approval, sale or entry into service of new buses (as well as as assemblies and components for these buses), the Contractor is obliged to implement the subject of the contract taking into account these changes. In particular, this obligation concerns the provision to the Contracting Authority of buses meeting the requirements specified in accordance with the above-mentioned provisions, as well as documents enabling these buses to be registered in the Republic of Poland. The buses are to be made with the use of technical achievements and workshop knowledge appropriate for the indicated age of the vehicles, ensuring trouble-free operation with a minimum of ongoing maintenance work. Vehicles are to be adapted to the needs of all users, including to be accessible to people with disabilities. The Contractor ensures that the construction of vehicles (including the quality and selection of materials used) has been made in accordance with applicable standards and regulations. The buses meet the requirements of Regulation No 107 of the European Commission for the Economy of the United Nations (UN/ECE) – uniform provisions concerning the approval of vehicles of category M3 with regard to their general construction The Contractor is obliged to submit to the Contracting Authority, at the latest on the date of technical acceptance of the first of the Vehicles, a ‘Vehicle Type Approval Certificate’ together with annexes confirming the unconditional granting of approval, issued in accordance with the applicable provisions, and in particular on the basis of the Road Traffic Act of 20 June 1997 and the Regulation of the Minister for Transport, Construction and the Maritime Economy of 25 March 2013 on the type-approval of motor vehicles and trailers and their items of equipment or parts. The buses supplied must be the same in their type, which means in particular that: 1.are identical in terms of picking, 2.are equipped with assemblies and components from the same manufacturer, 3.have bodywork with the same styling and external and internal colors, 4.contain identical equipment and organization of the driver's station, 5.are produced by the same manufacturer, 6.have the same warranty period for the whole vehicle, 7.have the same solution for heating the passenger space and the driver's cabin, 8.are to cooperate with the systems described in the draft provisions of the contract with attachments.
