As part of the technical assistance for the Luxembourg programmes co-financed by the ERDF, the regional policy department of the Ministry of the Economy carries out research under a service contract for a period of three years, renewable by negotiated procedure on the basis of Article 64(5) of the Law on public procurement: A senior staff member with a higher level of legal training for a technical assistance mission to management and control, answering the following profile (M/F): Firm slice: Under the authority of the Minister and the Head of Service, the service provider will be responsible for providing various services in the context of technical assistance to the operational programme for the period 2021-2027 and the following, on a maximum annual basis of 1760 hours and undertakes, in particular, to make every effort to comply with the regulations relating to the monitoring, management and control of the above-mentioned programme, in particular by carrying out the following tasks: - administrative and legal audit of the implementation of projects selected by the Managing Authority (legal and regulatory compliance, public procurement, State aid, eligibility of expenditure, etc.); - analysis of the positions taken by the European Commission or by any other institution against the Managing Authority and preparation of arguments in support of the latter's approach; - preparing to defend the interests of the Managing Authority against the findings and interpretations of the European Commission or any other institution following an inspection; - Preparation, participation and follow-up of administrative and legal audits of projects by national and European bodies (General Inspectorate of Finance, European Commission, European Court of Auditors); - Preparation and adaptation of internal guidelines in the regulatory fields (public procurement, State aid, fraud, conflicts of interest, revenue, costs, etc.), - Adaptation and updating of internal and external working documents (convention, management and control manual, all working documents). Optional annual tranche: Annual updating and monitoring of the management and control system of the ERDF AG (including taking into account system and operational audit findings): Content of the optional mission: - Update and follow-up of control procedures and control programme - Update and follow-up of control documentation - Update and follow-up of paper and digital archiving arrangements for control documentation - Update and follow-up of paper and digital control files - Update and follow-up of control checklists (including public procurement and state aid) - Documentary arrangements and requirements for beneficiaries - Update and follow-up agreement and application form - Update and follow-up Statement of assurance - Harmonisation and follow-up nomenclature control documentation - Update and follow-up of the management and control manual - Update and follow-up of the anti-fraud system The amount proposed for the optional tranche may not exceed 50% of the total contract for the firm tranche, will be lifted only by decision of the contracting authority and if budget during the 12-month period of each of the firm tranches set out in the contract. Award criteria: - Advanced training in European law (20 points), - Knowledge of the three Luxembourg administrative languages (Luxembourgish, French, German) (20 points), - Excellent knowledge of European Union law and in particular of the rules applicable to the Structural Funds, public procurement and State aid (20 points), - Experience of 3 to 5 years in the field of the Structural Funds if possible on behalf of a managing authority (20 points), - Experience of 3 to 5 years in the management and control of projects co-financed by the Structural Funds (20 points), - Experience in national and European audits in the field of the Structural Funds (20 points), - Mastery of the IT tool (10 points), - Knowledge of the Luxembourg economy appreciated (10 points), - Motivation, habit of teamwork, contact with the European institutions (10 points) A maximum total of 20 or 10 points is awarded to each criterion indicated in the tender specifications.
