Description

Drammen municipality c/o Drammen Eiendom KF intends to enter into a contract with Drammen Helsepark AS (“DHP”) for the hire of buildings for Drammen emergency doctor surgery and municipal health services, with an option for the purchase of the property/building. The building shall be erected by DHP and estimated take-over is 2029/2030. Geographical location with the possibility for co-location with the new Drammen hospital is decisive for the choice of site/hire object and follows from the announced zoning plan and health policy decisions. Any hire agreement is intended to include an area/building of approx. 17,000 m2 divided between 9 floors above ground, as well as technical rooms, common areas (possibly a footbridge to the hospital), parking rights etc. The hire period is planned for 20 years with right to extend for 10 + 10 years, or 30 years with right to extension for 10 years. The rent contract will also regulate the option for purchase. Drammen Helsepark is a development area of approx. 18 decares on the neighbouring site of the new Drammen Hospital on Brakerøya, located right up to the hospital. DHP (the group) owns the site for Drammen Helsepark. Development is in progress. The health park area is part of the plan area New Hospital in Drammen. The Hospital and health park area is regulated in the detailed plan of 3/ 17 Sept. 2019.From approx 2015 work has been done for co-housing with the hospital, cf. The Health, Social and Welfare Plan 2015-2018 Drammen municipality, the council case 71/15, 16.06.2015 and latest the council ́10.12.2024, case 187/24. The hospital is expected in operation in 2025.The entry of the hospital and the development of Drammen Helsepark are closely related both functionally and practically. DHP can develop subfield 2 (gbnr 113/1184, Drammen) for a building for emergency doctor surgery and municipal health services. Below ground on this and other subfields, a joint parking facility etc will be established for the building above. Drammen municipality is considering to enter into a contract with DHP Bygg BK2 AS (part of DHP group) for the rent of the building for use in municipal emergency doctor surgeries and health services. The aim is that co-location with the hospital and Helseparken shall give important synergy effects for patients, the local environment and society in large. The co-localisation facilitates cooperation, sharing experience and competence between different professional environments and educational institutions, etc. The patient groups planned to stay in a new health centre are a.o, patients on immediate help-24 hours and other patients with greater medical/multi-disciplinary needs. The municipality ́s research (see i.a. the municipal council case 187/24 10.12.2024) has shown a desire for increased cooperation in the health sector, and it is pointing out that a co-location allows for better interaction, more seamless patient pathways, efficient operation (and reduction in costs for patient transport), and innovation. There is also an option for a footbridge between the hospital and the health centre. A co-location can provide quick, safe and efficient patient transport, quick access to the hospital's facilities (such as x-ray/CT/MR), and enable quick moving of medical personnel in acute events and at times of the day with reduced staffing. When a rent contract is signed, it will be signed without a competition notice. The procurement is outside the scope of the procurement regulations and there are also grounds for awarding contracts without competition. The location next to the new hospital in Drammen (with the possibility for direct connection to the hospital building) is decisive for choosing a rental object. The announced regulation plan describes the hospital ́s and possibly the emergency doctor ́s/health building ́s location. Decisions connected to regulation and health policy decisions on co-localisation are the exercise of public authorities that are not included in the procurement regulations. It is not possible to hold a competition as the landlord, DHP/DHP Bygg BK2 AS, has ownership rights and thus the sole right to develop the site in question - gbnr 113/1184 in Drammen. There is, thus, a basis for awarding the landlord contract without a prior competition, cf. the Public Procurement Regulations § 13-4, letter b, no. 3. See also the public procurement regulations § 2-4, letter a that exempts the acquisition and hire of property. The exception is because the procurement and hire of real estate mostly depends on the geographical location and does not affect cross-border trade. The main element of the contract is hire/own the area with a geographical location that enables co-location with the new hospital. An assessment has been made of reasonable alternatives and there are no alternative areas with option for co-location with the hospital. A new hospital has already been placed and constructed. The assessment assumes that the co-location means that the establishment shall be so close to the hospital that the relocation of personnel and patients can take place without the use of an ambulance or car, and that the property must then be located on the same side of the railway line as the hospital. It is concluded that DHP is the only company that can offer a location in Drammen that allows co-location with the hospital. It will be aimless to start a competition when the aim of co-localisation with the hospital can only be achieved on the site in question. It is mainly municipal functions that are strengthened by being close to a hospital - such as the emergency doctor surgery and municipal health services - that are considered placed in the health park, cf. i.a. the council case 187/24 10.12.2024.The lessor shall hold a tender contest for construction works for the hire object in accordance with the procurement regulations. The objective of the procurement regulations is, thus, safeguarded. Deadline for objections: 10.02.25
