Description

1. The subject of the contract is comprehensive insurance of the Municipality of Police covering the Municipality of Police together with cultural institutions, organizational units, auxiliary units, Volunteer Fire Brigades and the Department of Water Supply and Sewerage Police Sp. z o.o. with the inclusion of insurance of Housing Communities administered by ZGKiM. The subject of the contract is divided into 9 lots. Task No 1 – Insurance against civil liability and property of the Municipality of Police together with cultural institutions, organisational units, auxiliary units and Voluntary Fire Brigades. Activity 2 – Liability and property insurance of the Municipal Waste Recovery and Storage Plant in Leśnia Górna. Task No 3 – Liability and property insurance of Zakład Wodociągów i Kanyzacji Police Sp. z o.o. Task No 4 – Insurance of Housing Communities administered by ZGKIM. Activity 5 – Accident insurance. Task No 6 – Civil liability insurance for members of the Voluntary Fire Brigades. Task No 7 – Transport insurance of Police Municipality together with cultural institutions, organisational units, auxiliary units and Voluntary Fire Brigades. Task No 8 – Motor insurance of Zakład Wodociągów i Kanyzacji Police Sp. z o.o. Task No 9 – Insurance of boats and civil liability of the shipowner in connection with the possession and operation of a vessel. 2. A detailed description of the subject-matter of the contract for each lot is set out in Annex 1 to the FTZ Description of the subject-matter of the contract, including Annexes A, A.1, A.2, A.3, A.4, A.5, A.6, A.7, B, C, C.1, C.2, C.3, C.4, D, D.1, D.2, E, E.1, E.2, F, F.1. The services must be performed in accordance with the applicable regulations and under the conditions laid down in the contracts and the FTZ. 3.The description of the subject of the contract constituting Annex 1 to the FTZ contains information of a confidential nature. The Ordering Party made this attachment available to the Contractor by sending it to the dedicated e-mail address of the person authorised to represent the Contractor indicated in the application sent to the Ordering Party, in accordance with the template constituting Annex 8 to the FTZ. The Contractor shall send the request in the form and manner specified in Chapter VI of the FTZ. The Contracting Authority shall send confidential information to the Contractor no later than the next working day following receipt of the Contractor’s request. Documents/information of a confidential nature (including changes and explanations of the content of the FTZ in the scope of Annex 1 will be sent to the e-mail address indicated by the Contractors in the submitted application. Documents/information of a confidential nature will be made available only to entities conducting insurance activity in the light of the provisions of the Act of 11 September 2015 on insurance and reinsurance activity. The Contractor undertakes to use confidential documents/information solely for the purpose of preparing the tender in the present proceedings. The Contractor is obliged to keep confidential all documents and information received in connection with the conduct of these proceedings in accordance with the principle set out in the Act on Insurance and Reinsurance Activity. The Contractor is obliged to make every effort to protect confidential information against access by unauthorised third parties.4. The tender form, constituting Annex 2 to the FTZ, should contain detailed information specifying which of the provisions of the general conditions of insurance or other standard contracts more favourable to the Ordering Party or insured persons than the provisions of this FTZ - if such provisions exist - will not apply in the tender. Lack of information means that the Contractor offers more favourable provisions for the Ordering Party or the insured. 5. The contracting authority provides for the award of contracts referred to in Art. 1 point 7 of the Public Procurement Act in the amount of up to 15% of the value of the basic contract for each task. Such a contract will consist in the repetition of similar services to those covered by the basic contract. The contract will be awarded directly. The contract will be performed under conditions similar to those set out in the contract concluded after the procedure in question has been carried out, after agreement with the Contractor performing the basic contract, on the understanding that the terms agreed will not be less favourable to the Contracting Authority than the terms of the basic contract, unless at the time of agreement there are circumstances which could not have been foreseen at the time of the award of the basic contract, which will make it impossible to agree on conditions not worse than those specified for the performance of the basic contract. 6. The Contracting Authority reserves the obligation for the Contractor to personally perform the following key parts of the service contract: the provision of insurance cover in the form of a willingness to pay compensation or other compensation specified in the contract for damage caused as a result of an accident provided for in the contract. The contractor who intends to entrust the performance of part of the contract to a subcontractor is obliged to indicate in the tender form, constituting Annex 2 to the FTZ, the parts of the contract whose performance he intends to entrust to a subcontractor and the companies of subcontractors, if they are already known. Lack of information in the tender form on the scope of the contract entrusted to subcontractors will be treated as a declaration of independent performance of the contract by the Contractor.
