Supply of a set of plant elements for organic synthesis

1. The subject of the contract is the supply of a set of elements of the plant for organic synthesis, in the form of a 50 l reactor with equipment, two 100 l reactors with equipment, a device for neutralizing toxic gases (scrubber), an oil vacuum pump, a filtration pump, two temperature control systems, additional equipment, together with their installation and training of the Contracting Authority's staff. 2. A detailed description of the subject-matter of the contract is contained in Annex No 1 to the FTZ (Description of the subject-matter of the contract – ‘OPZ’) and Annex No 7 to the FTZ (Draft provisions of the contract – ‘PPU’). 3. Description of the subject of the contract based on the Common Procurement Vocabulary (CPV): 42900000-5 - Miscellaneous general and special purpose machinery (main item) 42912000-2 - Machines and apparatus for filtering or purifying liquids 42122500-5 - Laboratory pumps and accessories 4. The contracting authority does not divide the contract into lots and thus does not allow the submission of partial tenders. Justification: The contract is entirely tailored to the needs of small and medium-sized enterprises within the meaning of Annex I to Commission Regulation (EU) No 651/2014 of 17 June 2014. The purpose of the contract is to provide a comprehensive and compatible set of organic synthesis apparatus, including glass reactors with equipment, auxiliary equipment, gas neutralisation system, vacuum pump, filtration systems and temperature control systems, together with the installation and training of the Contracting Authority’s staff. The lack of division of the contract into parts reduces the risk of technological incompatibility between the individual elements of the set and simplifies the implementation process - from delivery, through installation, to commissioning and training. The need to coordinate the activities of different contractors is eliminated, which could lead to additional costs, organisational difficulties and the risk of delays in implementation. Due to the principle of rational spending of funds by the Contracting Authority and the need to retain full responsibility of one contractor for the proper functioning of the entire system, the division of the contract into lots is pointless. 5. If, when describing the subject of the contract, the Contracting Authority refers to standards, technical assessments, technical specifications and technical reference systems referred to in Art. 2 and the mouth. 3 of the PPL Act, solutions equivalent to those described are allowed. Each phrase recorded in the FTZ referring to standards, technical assessments, technical specifications and technical reference system shall be read with the accompanying note 'or equivalent'. 6. If indications of trademarks, patents or origin appear in the description of the subject of the contract, they should be understood in accordance with Art. 5-6 of the Public Procurement Act, that this is justified by the specificity of the subject of the contract and the Employer cannot describe the subject of the contract using sufficiently precise terms. In such circumstances, the Ordering Party allows the possibility of submitting equivalent solutions in the offer, indicating that the minimum requirements to be met by equivalent solutions are requirements (functionality) not inferior to the parameters (functionality) indicated in the Description of the subject of the contract. The Contractor who relies on solutions equivalent to those described by the Ordering Party is obliged to demonstrate that the supplies offered by him meet the requirements specified by the Ordering Party. 7. In accordance with Art. If the subject-matter of the contract offered by the Contractor refers to standards equivalent to the standards, technical assessments, technical specifications and technical reference system referred to in the description of the subject-matter of the contract, the Contractor is obliged to submit with the tender the means of proof in question confirming that the proposed solutions meet the requirements (functionality) specified in the description of the subject-matter of the contract in an equivalent manner. 8. The Contracting Authority does not reserve the obligation for the Contractor to perform key tasks in person. 9. The contracting authority does not allow variants to be submitted. 10. The contracting authority does not provide for the conclusion of a framework contract. 11. The Contracting Authority does not provide for the selection of an offer using an electronic auction. 12. The contracting authority does not provide for reimbursement of the costs of participation in the procedure, subject to Article 261 of the Public Procurement Law. 13. The contracting authority does not provide for the requirements referred to in Art. 1 uPzp. 14. The Ordering Party does not allow the submission of offers in the form of electronic catalogues or the inclusion of electronic catalogues in the offer. 15. The Contracting Authority does not provide for the possibility of awarding contracts referred to in Art. 1 point 8 of the Public Procurement Act 16. Source of funding: The contract is co-financed by external funds from a targeted grant. 17. Pursuant to Article 257(1) of the Public Procurement Law, the contracting authority provides for the possibility of cancelling the procurement procedure if the public funds which the contracting authority intended to allocate to finance all or part of the contract have not been allocated to it.
