Description

The contracting authority pursues the acquisition of a complete WSG laboratory (genome sequencing) and related consumables by applying an open tender procedure with the conclusion of a 2-month supply contract with the successful tenderer. The contracting authority shall respond in a clear and complete manner to all requests for clarification on the 11st day before the deadline set for the submission of tenders, to the extent that they are submitted within the specified time limit. Number of days until which clarifications may be requested before the closing date for submission of tenders/applications: 18 days. The procedure for awarding the public procurement contract is initiated under this suspensive clause, in the sense that the conclusion of the public procurement contract is subject to the allocation of budget appropriations for this purpose, in the event of the extension of the project “Strengthening the control of tuberculosis in Romania through the implementation of the WHO END TB Strategy 2016-2020”, Contract No 1698/29.04.2020 financed by the Ministry of Health, under the EEA Financial Mechanism 2014-2021, the signing of the contract being in compliance with the provisions relating to the commitment of expenditure from the budgets covered by the legislation on public finances. In view of the provisions of Law 98/2016 on public procurement and Government Decision No 395/2016, as subsequently amended and supplemented, the Contracting Authority specifies that it will conclude the contract with the successful tenderer only to the extent that the funds necessary for the purchase will be secured by allocating budget appropriations for this purpose. If, for whatever reasons, the budget appropriations will not be allocated, for a period of 3 months from the date of approval of the report of the award procedure, the award procedure will be automatically cancelled, provided that there is no other source of financing, in accordance with the provisions of Art.212 paragraph (1) letter c) of Law 98/2016, as subsequently amended and supplemented, it is impossible to conclude the public procurement contract. The tenderers in this procedure understand that the Contracting Authority cannot be held liable for any damage in the event of cancellation of the award procedure, irrespective of its nature and irrespective of whether the Contracting Authority has been notified of the existence of such damage. Tenderers in this procedure accept the use of the above special conditions/suspensive clause, assuming full liability for any damage they may suffer in the situation described. The maximum period for which the suspension clause operates is 3 months, so that if the condition of signing the financing contract is not fulfilled, the award procedure is cancelled.’
