1. The subject of the contract is: Preparation of documentation for the task entitled: Expansion of provincial road No 849 on the Kaczórki-Malewszczyzna section as regards the construction of a road for pedestrians and bicycles.2. The purpose of the contract is to: a) Development of multi-discipline comprehensive project documentation at the stage of construction and implementation projects, together with geodetic and legal documentation, decisions and all arrangements and opinions, for the project entitled: ‘Extension of the Kaczórki – Malewszczyzna section of Voivodship Road No 849 with regard to the construction of a road for pedestrians and bicycles’ enabling a decision to be obtained on the permit for the implementation of a road investment (ZRID decision) pursuant to the Act of 10 April 2003 on special rules for the preparation and implementation of investments in public roads (Journal of Laws 2024, item 311 as amended) together with obtaining the opinions required by law, preparing the application together with all the required annexes. b) Development of materials and annexes necessary to obtain a decision on environmental conditions for the project together with its obtaining by the Contractor. c) Development of materials and annexes necessary to obtain a water and legal permit for the project together with its obtaining by the Contractor. d) Development of materials necessary to announce and conduct a tender for the execution of construction works, required by the Public Procurement Law and subsequent implementation of the task. 3. The Contractor shall ensure Author's Supervision during works carried out on the basis of design documentation drawn up within the scope specified by the Construction Law Act (Article 20 paragraph 1 point. 4 of the Journal of Laws 2024, item 725 as amended) and in accordance with the arrangements set out in the Agreement. The Author's Supervision will take place on the basis of the option law within the meaning of Article 441(1) of the Public Procurement Law Act. The commissioning of the Author's Supervision will depend on the needs of the Ordering Party. The Contractor is obliged to perform the Author's Supervision during the execution of works covered by the project documentation, the planned date of completion of the investment on December 31, 2028. 1) Author's Supervision includes: a) Author's supervision (with a maximum of 40 supervisions):  preparation of the material for supervision,  travel time from the design office to the construction site and back,  time spent on the construction site in one day,  handling matters related to supervision after return. b) Local author's supervision (maximum number of 35 supervisions):  simple activities carried out at the premises of the Project Unit, if this results from the needs of the investment, e.g. issuing an opinion, performing an analysis or preparing a letter not requiring presence at the construction site, etc. 4.Professional qualification of persons referred by the Contractor to perform the contract: 1) Having at least one person able to perform independent technical functions in the construction industry in the field of designing, checking architectural and construction projects for each of the following specialties: a) road, b) network installation, telecommunications installations and equipment, c) network installation, gas, water supply and sewage installations and equipment, d) network installation, electrical and electricity installations and equipment. 5. Each Contractor may submit one tender. Submission of more than one tender will result in rejection of all tenders submitted by the Contractor. 6.The Contracting Authority does not allow the possibility of submitting partial tenders - detailed justification is provided in SWZ.7. The Contracting Authority shall provide for partial payments for the Project Documentation in accordance with the provisions of the draft contract. 8. In accordance with Art. 1 and 2 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) Urz. The offer must include the net price, gross price including VAT due in accordance with the current law for: a) making design documentation, b) making one division of a plot or acquiring one plot in its entirety, c) performing author's supervision for one long-term stay and one act of local author's supervision. 10.The Ordering Party provides for the possibility of introducing changes to the concluded contract, on the basis of Article 455 of the Public Procurement Act and the provisions of the Draft Agreement. 11. The contracting authority, in accordance with Art. 1 of the Public Procurement Act will first examine and evaluate the tenders, and then make a qualitative selection of the Contractor whose tender was the highest scored, as regards the lack of grounds for exclusion and fulfilment of the conditions for participation in the procedure. 12.
