Logial-COOP decided, in order to meet its needs, to use the negotiated procedure without prior publicity and without a call for competition in accordance with Article R.2122-3-3° of the Public Procurement Code, on the following grounds: Logial-COOP cannot entrust to another operator the maintenance of the software package "Portallmmo Habitat" as well as the exploitation of license in Saas mode since the company AAREON France which designed these software packages, has the intellectual property rights and therefore the right of exclusivity allowing it to ensure the maintenance and exploitation of these software packages.
