The contracting authority provides for the possibility of exercising the right of option in accordance with Article 441 of the Public Procurement Act. The Ordering Party will exercise the right of option in the event of admission of new employees, organizational changes, including changes in workplaces, requiring the employee to be equipped with a business mobile phone, tablet, laptop with 5G / LTE mobile Internet access, in the event of theft, destruction or damage to devices that are not suitable for further use. At the latest before the conclusion of the contract, the Contractor shall provide the Ordering Party with a declaration of compliance with the requirement referred to in para. 6, i.e. that the person(s) performing activities related to the performance of the subject of the contract will be employed under an employment contract within the meaning of the Labour Code Act of 26 June 1974. 8. At each stage of contract implementation, the Contracting Authority has the right to verify the declaration of the contractor/subcontractor (concerning the form of employment of the persons referred to in sec. 6). To that end, it shall be entitled, in particular, to ask the competent labour inspectorate to carry out an inspection. 9. The Contracting Authority does not reserve the possibility of applying for a contract only by the Contractors referred to in Article 94 of the Public Procurement Act. 10.
