Description

1. The subject of the contract is the provision of electronic communication services, data transmission services – 5G/LTE mobile internet, delivery of brand new mobile phones with chargers and active and configured SIM cards for the needs of organisational units of Copernicus PL Sp. z o.o. for 42 months. CPV: 64212000-5- Mobile telephony services 64210000-1- Telephone and data services 32250000-0- Mobile phones 31158100-9- battery charger 31712112-8- SIM cards 2. A detailed description of the subject of the contract with a quantitative indication is set out in Annex 2 to the SWZ- Detailed Description of the subject of the contract. 3. The contracting authority provides for the possibility of exercising the right of option in accordance with Article 441 of the Public Procurement Act. The Ordering Party will exercise the right of option in the event of admission of new employees, organizational changes, including changes in workplaces, requiring the employee to be equipped with a business mobile phone, tablet, laptop with 5G / LTE mobile Internet access, in the event of theft, destruction or damage to devices that are not suitable for further use. The type and maximum value of the option is described in Annex I. 4 to the SWZ – price form, and Annex 2 to the SWZ – description of the subject of the contract and in Annex 7 to the SWZ – model contract. Unit prices of ordered items will remain unchanged throughout the duration of the contract. The Ordering Party will purchase the basic scope of the contract listed in the table constituting Annex 2 to the Price Form, in accordance with the provisions set out in the draft contract (Annex I). 7 to SWZ), and the subject of the contract covered by the option right will be purchased depending on the needs of the Ordering Party in accordance with the following rules: the right of option will be exercised under the same conditions as the basic order, the unit prices of the subject of the order purchased under the option will be the same as the basic order specified in the price form (Annex I). 4 to SWZ), about the intention to use the option, the Ordering Party shall inform the Contractor with a separate statement submitted before the expiry of the contract, the Ordering Party may exercise the option right within the term of the contract. Due to the fact that the given values and quantities of orders may change, the Contractor's remuneration will be payable according to the actual value of services and the number of deliveries. The Contractor shall not be entitled to any claim for the provision of services and supplies in the quantities specified in the offer as maximum. The Ordering Party declares that the total value of services and deliveries actually ordered by way of current orders will be not less than 80% of the total gross offer price indicated in the offer form. 5. The offered subject of the contract must be allowed to be marketed and used in accordance with applicable law. 6. Pursuant to Article 95 para. 1 of the Public Procurement Act, the Employer requires employment by the Contractor or a subcontractor on the basis of an employment contract within the meaning of the Labour Code of 26 June 1974 (Journal of Laws No. Journal of Laws 2019, item 1040, 1043 and 1495) continuously throughout the duration of the Agreement persons/persons performing activities related to the implementation of the subject of the contract: 1) Persons responsible for contacting the Ordering Party regarding the performance of the contract – including personal meetings, e-mail and telephone contact (acting as the Ordering Party's guardian). 7. At the latest before the conclusion of the contract, the Contractor shall provide the Ordering Party with a declaration of compliance with the requirement referred to in para. 6, i.e. that the person(s) performing activities related to the performance of the subject of the contract will be employed under an employment contract within the meaning of the Labour Code Act of 26 June 1974. 8. At each stage of contract implementation, the Contracting Authority has the right to verify the declaration of the contractor/subcontractor (concerning the form of employment of the persons referred to in sec. 6). To that end, it shall be entitled, in particular, to ask the competent labour inspectorate to carry out an inspection. 9. The Contracting Authority does not reserve the possibility of applying for a contract only by the Contractors referred to in Article 94 of the Public Procurement Act. 10.
