1. Subject of the contract. The subject-matter of this contract is the provision of maintenance services for equipment forming part of the mine’s ventilation air conditioning system at the Daniłowicz shaft and at the Paderewski shaft (hereinafter referred to as ‘air conditioning system’), hereinafter referred to as ‘maintenance services’. 2. Scope of maintenance services 2.1 Maintenance services include: 1) performing service readiness and providing consultations and advice on the operation and functioning of serviced equipment, on the terms set out in § 6 of the model contract, 2) removing operational defects and critical failures detected in the installation and performing repairs on the terms set out in § 7 of the model contract, 3) periodic service and maintenance inspections of serviced equipment included in the air-conditioning installation along with the purchase of all consumables necessary to perform inspections and diagnostics of the technical condition of the installation and analysis of the technological process, in order to prevent the occurrence of operational defects and critical failures, on the terms set out in § 8 of the model contract. Performing service readiness and providing consultations and advice on the operation and functioning of serviced devices 3.1 The Contractor undertakes to perform at least one-person service on-call 24 hours a day, 7 days a week. 4. 4.1 During the performance of the subject of the contract, the Contractor will be obliged to provide services consisting in removing operational defects or critical failures and performing repairs of air-conditioning installations in the amount of a maximum of 700 hours of work of one service technician. 5. 5.1 The performance of maintenance services in the field of service and maintenance inspections will take place within the time limits specified in the technical and operational documentation of the equipment included in the air-conditioning installation and the instructions for use of the equipment, within the time limits agreed each time in writing with the Ordering Party. 5.2 Service and maintenance inspections of air-conditioning installations should be carried out in accordance with the technical and operational documentation of the equipment included in the air-conditioning installation, and the Contractor is also obliged to: 1) diagnostics of the technical condition of the air-conditioning installation, 2) performing ad hoc maintenance services caused by the need to optimize the operation of the installation, 3) performing repair work aimed at removing irregularities found during the inspection in the operation of the air-conditioning installation and repairs resulting from the technical and operational documentation of the equipment included in the air-conditioning installation, 4) maintenance of individual equipment of the air-conditioning installation. 6. Spare parts 6.1 As part of the execution of the subject of the contract, subject to point. 10.2 and 10.3, the Ordering Party has the right to order separately, and the Contractor is obliged to purchase and deliver spare parts and components necessary to perform maintenance services.
