The subject of the contract is: Removal of hazardous waste from Wielkawsi Location: Wielkawieś, Stęszew Commune, Poznań County, Greater Poland Voivodeship. The estimated amount of waste is approx. 1 500,00 Mg. The above task is carried out on the basis of Decision No Oś.6236.1.2025 of 6 February 2025 of the Mayor of the Municipality of Stęszew, in connection with the need to take measures consisting in the removal and management of the waste in question due to the risk they pose to human health and life and the environment. A detailed description of the subject and scope of the contract is set out in Annex No 9 to the FTZ. The Ordering Party informs that before proceeding with the tender, the Ordering Party requires the Contractor to carry out, at his own expense, a local vision of the place where the services will be performed (waste warehouse at ul. Czereśniowa 7, Wielkawieś, Stęszew Commune). Carrying out a local vision is mandatory. The offer of the Contractor who does not carry out the on-site visit will be rejected. The contracting authority shall determine the days and a certain period of time during which it will be possible to carry out the on-site visit: Deadline I – 16.10.2025 (Thursday) at 6:00 p.m. 12:00 Deadline II – 21.10.2025 (Tuesday) at 1 p.m. 12:00 The contractor interested in carrying out the on-site inspection will be obliged by no later than the day preceding the above-mentioned deadline by 10.00 a.m. 13:00, inform the Ordering Party about the desire to carry out a local vision. Information (application) about the desire to carry out a on-site visit in the above-mentioned place should be sent using the Platform. A representative of the Contracting Authority will be present at the site of the on-site inspection within the specified time limit, which will allow the Contractors access to the waste storage area. The representative of the Contracting Authority shall not provide any information to the Contractors performing the vision. Any doubts concerning the subject of the contract shall be formulated by the Contractor in the request for clarification of the content of the specifications (SWZ) and transmitted via the Platform. The Contractor taking part in the on-site inspection shall assume full responsibility for securing OSH, the persons who will carry out the inspection on behalf of the Contractor. Social clause: The Contracting Authority requires that persons performing services and construction works specified in the tender documentation and equipment operators be employed on the basis of an employment contract by the Contractor or subcontractor, with the exception of persons whose duties do not consist in performing work in the manner specified in Article 22(1) of the Labour Code of 26 June 1974 (Journal of Laws of 1974, No. Journal of Laws 2023, item 1465), which may apply, among others, to the construction manager and managers of industrial works. Each time at the request of the Ordering Party, within the period specified by the Ordering Party not less than 5 working days, the Contractor undertakes to submit for inspection copies of employment contracts concluded by the Contractor with Employees providing services / construction works. Failure by the Contractor to submit a copy of the contracts concluded by the Contractor with the Workers providing services/construction works within the period specified by the Contracting Authority shall be treated as failure to comply with the obligation to employ Workers providing services/construction works on the basis of an employment contract. For failure to comply with the requirement to employ Employees providing services/construction works on the basis of an employment contract within the meaning of the provisions of the Labour Code, the Contractor shall pay the Contracting Authority contractual penalties in the amount specified in the draft contract attached to the FTZ.
